       The Conference Committee on SB 2146 recommended the following:
       
    1         Conference Committee Amendment (with title amendment)
    2  
    3         Delete everything after the enacting clause
    4  and insert:
    5         Section 1. Section 409.16713, Florida Statutes, is created
    6  to read:
    7         409.16713Allocation of funds for community-based care lead
    8  agencies.—
    9         (1) As used in this section, the term:
   10         (a) “Core services funding” means all funds allocated to
   11  community-based care lead agencies operating under contract with
   12  the department pursuant to s. 409.1671, with the following
   13  exceptions:
   14         1. Funds appropriated for independent living;
   15         2. Funds appropriated for maintenance adoption subsidies;
   16         3. Funds allocated by the department for protective
   17  investigations training;
   18         4. Nonrecurring funds;
   19         5. Designated mental health wrap-around services funds; and
   20         6. Funds for special projects for a designated community
   21  based care lead agency.
   22         (b) “Equity allocation model” means an allocation model
   23  that uses the following factors:
   24         1. Proportion of children in poverty;
   25         2. Proportion of child abuse hotline workload;
   26         3. Proportion of children in care; and
   27         4. Proportion of contribution in the reduction of out-of
   28  home care.
   29         (c) “Proportion of children in poverty” means the average
   30  of the proportion of children in the geographic area served by
   31  the community-based care lead agency based on the following
   32  subcomponents:
   33         1. Children up to 18 years of age who are below the poverty
   34  level as determined by the latest available Small Area Income
   35  and Poverty Estimates (SAIPE) from the United States Census
   36  Bureau;
   37         2. Children eligible for free or reduced-price meals as
   38  determined by the latest available survey published by the
   39  Department of Education; and
   40         3. The number of children in families receiving benefits
   41  from the federal Supplemental Nutrition Assistance Program
   42  (SNAP) in the most recent month as determined by the department.
   43         (d) “Proportion of child abuse hotline workload” means the
   44  weighted average of the following subcomponents:
   45         1. The average number of initial and additional child abuse
   46  reports received during the month for the most recent 12 months
   47  based on child protective investigations trend reports as
   48  determined by the department. This subcomponent shall be
   49  weighted as 20 percent of the factor.
   50         2. The average count of children in investigations in the
   51  most recent 12 months based on child protective investigations
   52  trend reports as determined by the department. This subcomponent
   53  shall be weighted as 40 percent of the factor.
   54         3. The average count of children in investigations with a
   55  most serious finding of verified abuse in the most recent 12
   56  months based on child protective investigations trend reports as
   57  determined by the department. This subcomponent shall be
   58  weighted as 40 percent of the factor.
   59         (e) “Proportion of children in care” means the proportion
   60  of the sum of the number of children in care receiving in-home
   61  services and the number of children in out-of-home care at the
   62  end of the most recent month as reported in the child welfare
   63  services trend reports as determined by the department.
   64         (f) “Proportion of contribution in the reduction of out-of
   65  home care” means the proportion of the number of children in
   66  out-of-home care on December 31, 2006, minus the number of
   67  children in out-of-home care as of the end of the most recent
   68  month as reported in the child welfare services trend reports as
   69  determined by the department.
   70         (2) The equity allocation of core services funds shall be
   71  calculated based on the following weights:
   72         (a) Proportion of children in poverty shall be weighted as
   73  30 percent of the total;
   74         (b) Proportion of child abuse hotline workload shall be
   75  weighted as 30 percent of the total;
   76         (c) Proportion of children in care shall be weighted as 30
   77  percent of the total; and
   78         (d) Proportion of contribution to the reduction in out-of
   79  home care shall be weighted as 10 percent of the total.
   80         (3) Beginning in the 2011-2012 state fiscal year, 75
   81  percent of the recurring core services funding for each
   82  community-based care lead agency shall be based on the prior
   83  year recurring base of core services funds and 25 percent shall
   84  be based on the equity allocation model.
   85         (4) For the 2011-2012 state fiscal year, any new core
   86  services funds shall be allocated based on the equity allocation
   87  model. Such allocations shall be proportional to the proportion
   88  of funding based on the equity model and allocated only to the
   89  community-based care lead agency contracts where the current
   90  funding proportion is less than the proportion of funding based
   91  on the equity model.
   92         Section 2. This act shall take effect July 1, 2011.
