| 2 | An act relating to public school education; requiring the |
| 3 | Florida Comprehensive Assessment Test (FCAT) in reading |
| 4 | for grade 3 students to be administered as a diagnostic |
| 5 | tool; providing that performance on grade 3 FCAT Reading |
| 6 | must not be the sole determining factor for retention of |
| 7 | grade 3 students; providing an effective date. |

| 9 | Be It Enacted by the Legislature of the State of Florida: |
| 10 |

| 11 | Section 1. Notwithstanding ss. 1008.22 and 1008.25, |
| 12 | Florida Statutes, and any other provision of law to the |
| 13 | contrary, the Florida Comprehensive Assessment Test (FCAT) in |
| 14 | reading for grade 3 students shall be administered as a |
| 15 | diagnostic tool to assess a student's reading proficiency. A |
| 16 | student in grade 3 who does not earn a passing score on grade 3 |
| 17 | FCAT Reading must not be retained in grade 3 based solely on his |
| 18 | or her performance on FCAT Reading. The school site |
| 19 | administrator and the student's teacher, in consultation with |
| 20 | the student's parent, shall make the determination as to the |
| 21 | student's promotion or retention. |
| 22 | Section 2. This act shall take effect July 1, 2011. |
