| 1 | A bill to be entitled | 
| 2 | An act relating to adultery, cohabitation, and lewd and  | 
| 3 | lascivious behavior; repealing s. 798.01, F.S., relating  | 
| 4 | to living in open adultery; amending s. 798.02, F.S.;  | 
| 5 | deleting language that made a prohibition on couples  | 
| 6 | lewdly and lasciviously associating and cohabiting  | 
| 7 | together a part of a prohibition of lewd and lascivious  | 
| 8 | behavior; providing an effective date. |

| 10 | Be It Enacted by the Legislature of the State of Florida: | 
| 11 | 
  | 
| 12 |      Section 1.  Section 798.01, Florida Statutes, is repealed. | 
| 13 |      Section 2.  Section 798.02, Florida Statutes, is amended to  | 
| 14 | read: | 
| 15 |      798.02  Lewd and lascivious behavior.-If Any man and woman,  | 
| 16 | not being married to each other, lewdly and lasciviously  | 
| 17 | associate and cohabit together, or if any man or woman, married  | 
| 18 | or unmarried, who engage engages in open and gross lewdness and  | 
| 19 | lascivious behavior with each other each commit, they shall be  | 
| 20 | guilty of a misdemeanor of the second degree, punishable as  | 
| 21 | provided in s. 775.082 or s. 775.083. | 
| 22 |      Section 3.  This act shall take effect July 1, 2011. |
