A bill to be entitled
2An act relating to the repeal of health insurance
3provisions; amending s. 627.64872, F.S.; deleting a
4requirement that the annual report of The Florida Health
5Insurance Plan's board of directors include certain
6actuarial information relating to levels of coverage and
7funding; amending s. 627.6699, F.S.; deleting a
8requirement that the Office of Insurance Regulation of the
9Department of Financial Services annually report to the
10Governor and the Legislature concerning the Small
11Employers Access Program; providing an effective date.

13Be It Enacted by the Legislature of the State of Florida:

15     Section 1.  Subsection (6) of section 627.64872, Florida
16Statutes, is amended to read:
17     627.64872  Florida Health Insurance Plan.-
18     (6)  ANNUAL REPORT.-The board shall annually submit to the
19Governor, the President of the Senate, and the Speaker of the
20House of Representatives a report that includes an independent
21actuarial study to determine, without limitation, the following:
22     (a)  The effect the creation of the plan has on the small
23group and individual insurance market, specifically on the
24premiums paid by insureds, including an estimate of the total
25anticipated aggregate savings for all small employers in the
26state.
27     (b)  The actual number of individuals covered at the
28current funding and benefit level, the projected number of
29individuals that may seek coverage in the forthcoming fiscal
30year, and the projected funding needed to cover anticipated
31increase or decrease in plan participation.
32     (b)(c)  A recommendation as to the best source of funding
33for the anticipated deficits of the pool.
34     (c)(d)  A summary of the activities of the plan in the
35preceding calendar year, including the net written and earned
36premiums, plan enrollment, the expense of administration, and
37the paid and incurred losses.
38     (d)(e)  A review of the operation of the plan as to whether
39the plan has met the intent of this section.

41The board may not implement the Florida Health Insurance Plan
42until funds are appropriated for startup costs and any projected
43deficits; however, the board may complete the actuarial study
44authorized in this subsection.
45     Section 2.  Paragraph (l) of subsection (15) of section
46627.6699, Florida Statutes, is amended to read:
47     627.6699  Employee Health Care Access Act.-
48     (15)  SMALL EMPLOYERS ACCESS PROGRAM.-
49     (l)  Annual reporting.-The office shall make an annual
50report to the Governor, the President of the Senate, and the
51Speaker of the House of Representatives. The report shall
52summarize the activities of the program in the preceding
53calendar year, including the net written and earned premiums,
54program enrollment, the expense of administration, and the paid
55and incurred losses. The report shall be submitted no later than
56March 15 following the close of the prior calendar year.
57     Section 3.  This act shall take effect July 1, 2011.
