A bill to be entitled
2An act relating to tattooing; repealing s. 877.04, F.S.,
3and s. 9, ch. 2010-220, Laws of Florida, relating to
4requirements for and prohibitions on the tattooing of
5minor children and the penalties for violation thereof;
6amending ss. 381.00773 and 381.00779, F.S.; conforming to
7the repeal of s. 877.04, F.S., by the act, which was to
8have been transferred to s. 381.00787, F.S., effective
9January 1, 2012, by 9, ch. 2010-220, Laws of Florida;
10providing effective dates.

12Be It Enacted by the Legislature of the State of Florida:
13
14     Section 1.  Section 877.04, Florida Statutes, and section 9
15of chapter 2010-220, Laws of Florida, are repealed.
16     Section 2.  Effective January 1, 2012, subsection (1) of
17section 381.00773, Florida Statutes, is amended to read:
18     381.00773  Application of ss. 381.00771-381.00791;
19exemption.-
20     (1)  Sections Except for s. 381.00787, which applies to all
21persons, ss. 381.00771-381.00791 do not apply to a person
22licensed to practice medicine or dentistry under chapter 458,
23chapter 459, or chapter 466 who performs tattooing exclusively
24for medical or dental purposes.
25     Section 3.  Effective January 1, 2012, subsection (3) of
26section 381.00779, Florida Statutes, is amended to read:
27     381.00779  Practice requirements.-
28     (3)  A tattoo artist or guest tattoo artist may tattoo the
29body of a minor child only to the extent authorized in s.
30381.00787. A tattoo establishment or temporary establishment
31must keep, for the period prescribed by the department, each
32written notarized consent submitted under s. 381.00787(2)(c) by
33the parent or legal guardian of a minor child who is tattooed at
34the establishment.
35     Section 4.  Except as otherwise expressly provided in this
36act, this act shall take effect July 1, 2011.
