       Senator Bennett moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 14 - 60
    4  and insert:
    5         Section 1. Paragraphs (aaaa) and (bbbb) are added to
    6  subsection (4) of section 320.08056, Florida Statutes, and
    7  subsection (9) of that section is amended to read:
    8         320.08056 Specialty license plates.—
    9         (4) The following license plate annual use fees shall be
   10  collected for the appropriate specialty license plates:
   11         (aaaa) Go Green license plate, $25.
   12         (bbbb) Republican Party of Florida and Florida Democratic
   13  Party license plates, $35.
   14         (9)(a) The organization that requested the specialty
   15  license plate may not redesign the specialty license plate
   16  unless the inventory of those plates has been depleted. However,
   17  the organization may purchase the remaining inventory of the
   18  specialty license plates from the department at cost.
   19         (b) An organization with a specialty license plate must
   20  submit a written request to the department 90 days before the
   21  convening of the next regular session of the Legislature in
   22  order to change the name of the recipient organization listed in
   23  this section or s. 320.08058.
   24         Section 2. Subsection (29), paragraph (b) of subsection
   25  (48), and subsection (53) of section 320.08058, Florida
   26  Statutes, are amended and subsections (79) and (80) are added to
   27  that section to read:
   28         320.08058 Specialty license plates.—
   29         (29) CHOOSE LIFE LICENSE PLATES.—
   30         (a) The department shall develop a Choose Life license
   31  plate as provided in this section. The word “Florida” must
   32  appear at the bottom of the plate, and the words “Choose Life”
   33  must appear at the top of the plate.
   34         (b) The annual use fees shall be distributed annually to
   35  Choose Life, Inc., along with a report that specifies each
   36  county in the ratio that the annual use fees collected by each
   37  county bear bears to the total fees collected for the plates
   38  within the state. Choose Life, Inc., Each county shall
   39  distribute the funds to nongovernmental, not-for-profit agencies
   40  that assist within the county, which agencies’ services are
   41  limited to counseling and meeting the physical needs of pregnant
   42  women who are making an adoption plan for their children
   43  committed to placing their children for adoption. Funds may not
   44  be distributed to any agency that is involved or associated with
   45  abortion activities, including counseling for or referrals to
   46  abortion clinics, providing medical abortion-related procedures,
   47  or proabortion advertising, and funds may not be distributed to
   48  any agency that charges women for services received.
   49         1. Agencies that receive the funds must use at least 70
   50  percent of the funds to provide for the material needs of
   51  pregnant women who are making an adoption plan for their
   52  children committed to placing their children for adoption,
   53  including, but not limited to, clothing, housing, medical care,
   54  food, utilities, and transportation. Such funds may also be
   55  expended on birth mothers for 60 days after delivery and on
   56  infants awaiting placement with adoptive parents.
   57         2. The remaining Funds may also be used for adoption
   58  related adoption, counseling, training, or advertising, but may
   59  not be used for administrative expenses, legal expenses, or
   60  capital expenditures. However, a maximum of 20 percent of the
   61  total funds received annually may be used by Choose Life, Inc.,
   62  for the administration and promotion of the Choose Life license
   63  plate program.
   64         3. Each agency that receives such funds must submit an
   65  annual attestation to Choose Life, Inc. the county. Any unused
   66  funds that exceed 10 percent of the funds received by an agency
   67  each during its fiscal year must be returned to Choose Life,
   68  Inc. the county, which shall distribute the funds them to other
   69  qualified agencies.
   70         (c) By October 1, 2011, the department and each county
   71  shall transfer all of its Choose Life license plate funds to
   72  Choose Life, Inc.
   73         (48) LIVE THE DREAM LICENSE PLATES.—
   74         (b) The proceeds of the annual use fee shall be distributed
   75  to the Florida Dream Foundation, Inc. The Florida Dream
   76  Foundation, Inc., shall retain the first $60,000 in proceeds
   77  from the annual use fees as reimbursement for administrative
   78  costs, startup costs, and costs incurred in the approval
   79  process. Thereafter, up to 25 percent shall be used for
   80  continuing promotion and marketing of the license plate and
   81  concept. The remaining funds shall be used in the following
   82  manner:
   83         1. Twenty-five percent shall be distributed equally among
   84  the sickle cell organizations that are Florida members of the
   85  Sickle Cell Disease Association of America, Inc., for programs
   86  that provide research, care, and treatment for sickle cell
   87  disease.
   88         2. Twenty-five percent shall be distributed to the Florida
   89  chapter of the March of Dimes for programs and services that
   90  improve the health of babies through the prevention of birth
   91  defects and infant mortality.
   92         3. Ten percent shall be distributed to the Florida
   93  Association of Healthy Start Coalitions to decrease racial
   94  disparity in infant mortality and to increase healthy birth
   95  outcomes. Funding will be used by local Healthy Start Coalitions
   96  to provide services and increase screening rates for high-risk
   97  pregnant women, children under 4 years of age, and women of
   98  childbearing age.
   99         4. Ten percent shall be distributed to the Community
  100  Partnership for Homeless, Inc., for programs that provide relief
  101  from poverty, hunger, and homelessness.
  102         5. Five percent of the proceeds shall be used by the
  103  foundation for administrative costs directly associated with
  104  operations as they relate to the management and distribution of
  105  the proceeds.
  106         (53) SUPPORT SOCCER LICENSE PLATES.—
  107         (a) The department shall develop a Support Soccer license
  108  plate as provided in this section. Support Soccer license plates
  109  must bear the colors and design approved by the department. The
  110  word “Florida” must appear at the top of the plate, and the
  111  words “Support Soccer” must appear at the bottom of the plate.
  112         (b) The annual use fees shall be distributed to the Florida
  113  Lighthouse Soccer Foundation, Inc., which shall retain the
  114  initial revenues from the sale of such plates until all startup
  115  costs for developing and establishing the plate have been
  116  recovered, not to exceed $85,000. Thereafter, the proceeds of
  117  the annual use fee shall be used in the following manner:
  118         1. Up to 25 percent of the proceeds may be used by the
  119  Florida Lighthouse Soccer Foundation, Inc., for continuing
  120  promotion and marketing of the license plate and concept.
  121         2. Twenty percent shall be distributed to the Florida Youth
  122  Soccer Association for programs and services that foster the
  123  physical, mental, and emotional growth and development of
  124  Florida’s youth through the sport of soccer at all levels of age
  125  and competition, including a portion to be determined by the
  126  Florida Youth Soccer Association for the TOPSoccer program to
  127  promote participation by the physically and mentally
  128  disadvantaged.
  129         3. Twenty percent shall be distributed as grants for
  130  programs that promote participation by the economically
  131  disadvantaged and to support soccer programs where none
  132  previously existed.
  133         4. Ten percent shall be distributed to the Florida State
  134  Soccer Association to promote the sport of soccer and the long
  135  term development of the sport.
  136         5. Ten percent shall be distributed as grants for programs
  137  that promote and support the construction of fields and soccer
  138  specific infrastructure.
  139         6. Ten percent shall be distributed as grants for programs
  140  that foster and promote health, physical fitness, and
  141  educational opportunities through soccer.
  142         7. Five percent shall be expended by the Florida Lighthouse
  143  Soccer Foundation, Inc., for administrative costs directly
  144  associated with the foundation’s operations as they relate to
  145  the management and distribution of the proceeds.
  146         (79) GO GREEN LICENSE PLATE.-
  147         (a) Notwithstanding the provisions of s. 45 of chapter
  148  2008-176, Laws of Florida, as amended by s. 21 of chapter 2010
  149  223, Laws of Florida, and upon receipt of $60,000 and submission
  150  of the proposed art design for the specialty license plate to
  151  the department in a medium prescribed by the department, as soon
  152  as practicable, but no later than 60 days after the effective
  153  date of this act, the department shall develop a Go Green
  154  license plate as provided in this section. The plate must bear
  155  the colors and design approved by the department. The word
  156  “Florida” must appear at the top of the plate, and the words “Go
  157  Green” must appear at the bottom of the plate.
  158         (b) The annual use fees shall be distributed to the
  159  Coalition for Renewable Energy Solutions, Inc., which shall
  160  retain the initial revenues from the sales of such plates until
  161  all startup costs incurred in the development and approval of
  162  the plates have been reimbursed. Thereafter, the proceeds shall
  163  be used by the coalition as follows:
  164         1. A maximum of 10 percent of the proceeds may be used to
  165  fund the administrative and marketing costs of the license plate
  166  program.
  167         2. The remaining fees shall be used to fund programs and
  168  projects that educate the public and implement or publicize
  169  renewable energy solutions.
  170         (80) REPUBLICAN PARTY OF FLORIDA and FLORIDA DEMOCRATIC
  171  PARTY LICENSE PLATES.—
  172         (a) Notwithstanding the provisions of s. 320.08053, the
  173  department shall develop a Republican Party of Florida license
  174  plate and a Florida Democratic Party license plate, as provided
  175  in this section. The plates must bear the colors and design
  176  approved by the department and the official logo of the
  177  Republican Party of Florida or the Florida Democratic Party must
  178  appear between the numerals. To further the state interest in
  179  increasing voter participation in Florida elections, the plate
  180  must also include the words “I VOTE.”
  181         (b) The department shall retain all revenues from the sale
  182  of such plates until all startup costs for developing and
  183  issuing the plates have been recovered. Thereafter, all of the
  184  annual revenues of the Republican plates shall be distributed to
  185  the Republican Party of Florida and all of the annual revenues
  186  of the Democrat plates shall be distributed to the Florida
  187  Democratic Party. Such funds shall be deposited in a separate
  188  account to be used to support voter registration, absentee
  189  ballot registration, voter contact, and administration and
  190  marketing of the plates. No revenues shall be used for political
  191  advertisements as defined in s. 106.011.
  192         (c) From the funds distributed to the Republican Party of
  193  Florida and to the Florida Democratic Party, an amount not to
  194  exceed 15 percent of the annual revenues received from the sale
  195  of the plates may be used for administration and marketing of
  196  the plates.

  201  and insert:
  202         An act relating to speciality license plates; amending
  203         s. 320.08056, F.S.; relating to specialty license
  204         plates; providing a fee for Go Green license plates;
  205         revising procedures to change the name of a recipient
  206         of the fees collected; creating Republican Party of
  207         Florida and the Florida Democratic Party license
  208         plates; establishing an annual use fee for the plates;
  209         amending s. 320.08058, F.S.; providing for
  210         distribution of fees collected; changing the recipient
  211         of the proceeds for the Live the Dream license plates
  212         to the Florida Dream Foundation, Inc.; providing that
  213         proceeds from the sale of Support Soccer license
  214         plates shall be distributed to the Florida Soccer
  215         Foundation, Inc.; providing for a Go Green License
  216         plate; creating a Republican Party of Florida and a
  217         Florida Democratic Party license plate and providing
  218         for the distribution of annual use fees received from
  219         the sale of such plates; providing for the annual use
  220         fees to be distributed to Choose Life, Inc., rather
  221         than the counties; providing for Choose Life, Inc., to
  222         redistribute a portion of such funds to
  223         nongovernmental, not-for-profit agencies that assist
  224         certain pregnant women; authorizing Choose Life, Inc.,
  225         to use a portion of the funds to administer and
  226         promote the Choose Life license plate program;
  227         providing an effective date.
