A bill to be entitled
2An act relating to criminal conduct; amending s. 827.03,
3F.S.; defining the term "mental injury" with respect to
4the offenses of abuse, aggravated abuse, and neglect of a
5child; requiring that a person acting as an expert witness
6have certain credentials; providing affirmative defenses
7to the offenses of child abuse, aggravated child abuse,
8and neglect; amending ss. 775.084, 775.0877, 782.07,
9921.0022, and 948.062, F.S.; conforming cross-references;
10amending s. 960.03, F.S.; redefining the term "crime" for
11purposes of crime victims compensation to include
12additional forms of injury; redefining the term "victim"
13to conform with the modified definition of the term
14"crime"; providing an effective date.

16Be It Enacted by the Legislature of the State of Florida:
17
18     Section 1.  Section 827.03, Florida Statutes, is amended to
19read:
20     827.03  Abuse, aggravated abuse, and neglect of a child;
21penalties.-
22     (1)  DEFINITIONS.-For purposes of this section:
23     (a)  "Aggravated child abuse" occurs when a person:
24     1.  Commits aggravated battery on a child;
25     2.  Willfully tortures, maliciously punishes, or willfully
26and unlawfully cages a child; or
27     3.  Knowingly or willfully abuses a child and in so doing
28causes great bodily harm, permanent disability, or permanent
29disfigurement to the child.
30     (b)  "Child abuse" means:
31     1.(a)  Intentional infliction of physical or mental injury
32upon a child;
33     2.(b)  An intentional act that could reasonably be expected
34to result in physical or mental injury to a child; or
35     3.(c)  Active encouragement of any person to commit an act
36that results or could reasonably be expected to result in
37physical or mental injury to a child.

39A person who knowingly or willfully abuses a child without
40causing great bodily harm, permanent disability, or permanent
41disfigurement to the child commits a felony of the third degree,
42punishable as provided in s. 775.082, s. 775.083, or s. 775.084.
43     (2)  "Aggravated child abuse" occurs when a person:
44     (a)  Commits aggravated battery on a child;
45     (b)  Willfully tortures, maliciously punishes, or willfully
46and unlawfully cages a child; or
47     (c)  Knowingly or willfully abuses a child and in so doing
48causes great bodily harm, permanent disability, or permanent
49disfigurement to the child.

51A person who commits aggravated child abuse commits a felony of
52the first degree, punishable as provided in s. 775.082, s.
53775.083, or s. 775.084.
54     (c)  "Maliciously" means wrongfully, intentionally, and
55without legal justification or excuse. Maliciousness may be
56established by circumstances from which one could conclude that
57a reasonable parent would not have engaged in the damaging acts
58toward the child for any valid reason and that the primary
59purpose of the acts was to cause the victim unjustifiable pain
60or injury.
61     (d)  "Mental injury" shall mean multiple instances of
62injury caused by the same abuser to the intellectual or
63psychological capacity of a child as evidenced by a discernible
64and substantial impairment in the ability of the child to
65function within the normal range of performance and behavior as
66supported by expert testimony. A person may not give expert
67testimony regarding mental injury unless that person is a
68physician licensed under chapter 458 or chapter 459 who is board
69certified in psychiatry and has devoted professional time during
70the 3 years immediately preceding the date of the occurrence to
71the active clinical practice of, or consulting with respect to,
72a specialty that includes the evaluation, diagnosis, or
73treatment of the condition that is the subject of the offense.
74     (e)(3)(a)  "Neglect of a child" means:
75     1.  A caregiver's failure or omission to provide a child
76with the care, supervision, and services necessary to maintain
77the child's physical and mental health, including, but not
78limited to, food, nutrition, clothing, shelter, supervision,
79medicine, and medical services that a prudent person would
80consider essential for the well-being of the child; or
81     2.  A caregiver's failure to make a reasonable effort to
82protect a child from abuse, neglect, or exploitation by another
83person.

85Except as otherwise provided in this section, neglect of a child
86may be based on repeated conduct or on a single incident or
87omission that results in, or could reasonably be expected to
88result in, serious physical or mental injury, or a substantial
89risk of death, to a child.
90     (2)  OFFENSES.-
91     (a)  A person who commits aggravated child abuse commits a
92felony of the first degree, punishable as provided in s.
93775.082, s. 775.083, or s. 775.084.
94     (b)  A person who willfully or by culpable negligence
95neglects a child and in so doing causes great bodily harm,
96permanent disability, or permanent disfigurement to the child
97commits a felony of the second degree, punishable as provided in
98s. 775.082, s. 775.083, or s. 775.084.
99     (c)  A person who knowingly or willfully abuses a child
100without causing great bodily harm, permanent disability, or
101permanent disfigurement to the child commits a felony of the
102third degree, punishable as provided in s. 775.082, s. 775.083,
103or s. 775.084.
104     (d)(c)  A person who willfully or by culpable negligence
105neglects a child without causing great bodily harm, permanent
106disability, or permanent disfigurement to the child commits a
107felony of the third degree, punishable as provided in s.
108775.082, s. 775.083, or s. 775.084.
109     (3)  AFFIRMATIVE DEFENSES.-
110     (a)  If the offense charged under this section is based
111solely on oral statements of the defendant, it shall be an
112affirmative defense to prosecution of that offense that the
113conduct giving rise to the offense was solely speech protected
114by the First Amendment to the United States Constitution. This
115affirmative defense shall not apply to speech that was directed
116to inciting or producing imminent lawless action and that was
117likely to incite or produce such action.
118     (b)  If the offense charged under this section is based
119solely on a claim of mental injury because of a caregiver's
120failure to make a reasonable effort to protect a child from an
121abuser other than the defendant, it shall be an affirmative
122defense to a prosecution of that offense that the defendant was
123a victim of an act of domestic violence as defined in s. 741.28
124or had reasonable cause to believe that he or she was about to
125become a victim of an act of domestic violence, and the
126defendant had reasonable cause to believe that the action or
127failure to act was necessary in order for the defendant to
128escape from, or protect himself or herself from, the domestic
129violence or to preserve the minor or incompetent person from
130exposure to domestic violence. However, this affirmative defense
131shall not be available to any person in relation to instances of
132child abuse arising after the defense has been previously
133asserted with respect to the same abuser.
134     (4)  For purposes of this section, "maliciously" means
135wrongfully, intentionally, and without legal justification or
136excuse. Maliciousness may be established by circumstances from
137which one could conclude that a reasonable parent would not have
138engaged in the damaging acts toward the child for any valid
139reason and that the primary purpose of the acts was to cause the
140victim unjustifiable pain or injury.
141     Section 2.  Paragraph (d) of subsection (1) of section
142775.084, Florida Statutes, is amended to read:
143     775.084  Violent career criminals; habitual felony
144offenders and habitual violent felony offenders; three-time
145violent felony offenders; definitions; procedure; enhanced
146penalties or mandatory minimum prison terms.-
147     (1)  As used in this act:
148     (d)  "Violent career criminal" means a defendant for whom
149the court must impose imprisonment pursuant to paragraph (4)(d),
150if it finds that:
151     1.  The defendant has previously been convicted as an adult
152three or more times for an offense in this state or other
153qualified offense that is:
154     a.  Any forcible felony, as described in s. 776.08;
155     b.  Aggravated stalking, as described in s. 784.048(3) and
156(4);
157     c.  Aggravated child abuse, as described in s.
158827.03(2)(a);
159     d.  Aggravated abuse of an elderly person or disabled
160adult, as described in s. 825.102(2);
161     e.  Lewd or lascivious battery, lewd or lascivious
162molestation, lewd or lascivious conduct, or lewd or lascivious
163exhibition, as described in s. 800.04 or s. 847.0135(5);
164     f.  Escape, as described in s. 944.40; or
165     g.  A felony violation of chapter 790 involving the use or
166possession of a firearm.
167     2.  The defendant has been incarcerated in a state prison
168or a federal prison.
169     3.  The primary felony offense for which the defendant is
170to be sentenced is a felony enumerated in subparagraph 1. and
171was committed on or after October 1, 1995, and:
172     a.  While the defendant was serving a prison sentence or
173other sentence, or court-ordered or lawfully imposed supervision
174that is imposed as a result of a prior conviction for an
175enumerated felony; or
176     b.  Within 5 years after the conviction of the last prior
177enumerated felony, or within 5 years after the defendant's
178release from a prison sentence, probation, community control,
179control release, conditional release, parole, or court-ordered
180or lawfully imposed supervision or other sentence that is
181imposed as a result of a prior conviction for an enumerated
182felony, whichever is later.
183     4.  The defendant has not received a pardon for any felony
184or other qualified offense that is necessary for the operation
185of this paragraph.
186     5.  A conviction of a felony or other qualified offense
187necessary to the operation of this paragraph has not been set
188aside in any postconviction proceeding.
189     Section 3.  Paragraphs (h) and (i) of subsection (1) of
190section 775.0877, Florida Statutes, are amended to read:
191     775.0877  Criminal transmission of HIV; procedures;
192penalties.-
193     (1)  In any case in which a person has been convicted of or
194has pled nolo contendere or guilty to, regardless of whether
195adjudication is withheld, any of the following offenses, or the
196attempt thereof, which offense or attempted offense involves the
197transmission of body fluids from one person to another:
198     (h)  Section 827.03(2)(c)(1), relating to child abuse;
199     (i)  Section 827.03(2)(a), relating to aggravated child
200abuse;

202the court shall order the offender to undergo HIV testing, to be
203performed under the direction of the Department of Health in
204accordance with s. 381.004, unless the offender has undergone
205HIV testing voluntarily or pursuant to procedures established in
206s. 381.004(3)(h)6. or s. 951.27, or any other applicable law or
207rule providing for HIV testing of criminal offenders or inmates,
208subsequent to her or his arrest for an offense enumerated in
209paragraphs (a)-(n) for which she or he was convicted or to which
210she or he pled nolo contendere or guilty. The results of an HIV
211test performed on an offender pursuant to this subsection are
212not admissible in any criminal proceeding arising out of the
213alleged offense.
214     Section 4.  Subsection (3) of section 782.07, Florida
215Statutes, is amended to read:
216     782.07  Manslaughter; aggravated manslaughter of an elderly
217person or disabled adult; aggravated manslaughter of a child;
218aggravated manslaughter of an officer, a firefighter, an
219emergency medical technician, or a paramedic.-
220     (3)  A person who causes the death of any person under the
221age of 18 by culpable negligence under s. 827.03(2)(b)(3)
222commits aggravated manslaughter of a child, a felony of the
223first degree, punishable as provided in s. 775.082, s. 775.083,
224or s. 775.084.
225     Section 5.  Paragraphs (f), (g), and (i) of subsection (3)
226of section 921.0022, Florida Statutes, are amended to read:

451     Section 6.  Paragraph (f) of subsection (1) of section

454by offenders placed on probation or community control.-
455     (1)  The department shall review the circumstances related
456to an offender placed on probation or community control who has
457been arrested while on supervision for the following offenses:
458     (f)  Any aggravated child abuse as provided in s.
459827.03(2)(a);
460     Section 7.  Paragraph (a) of subsection (3) and subsection
461(14) of section 960.03, Florida Statutes, are amended to read:
462     960.03  Definitions; ss. 960.01-960.28.-As used in ss.
463960.01-960.28, unless the context otherwise requires, the term:
464     (3)  "Crime" means:
465     (a)  A felony or misdemeanor offense committed by either an
466adult or a juvenile which results in physical injury or death,
467including a felony or misdemeanor offense committed by either an
468adult or a juvenile which results in psychiatric or
469psychological injury to a person less than 18 years of age who
470was not physically injured by the criminal act. The term also
471includes any such criminal act which is committed within this
472state but which falls exclusively within federal jurisdiction.
473     (14)  "Victim" means:
474     (a)  A person who suffers personal physical injury or death
475as a direct result of a crime;
476     (b)  Except as otherwise set forth in paragraph (3)(a)
477concerning injuries to minors, a person younger than 18 years of
478age who was present at the scene of a crime, saw or heard the
479crime, and suffered a psychiatric or psychological injury
480because of the crime, but who was not physically injured; or
481     (c)  A person against whom a forcible felony was committed
482and who suffers a psychiatric or psychological injury as a
483direct result of that crime but who does not otherwise sustain a
484personal physical injury or death.
485     Section 8.  This act shall take effect July 1, 2011.
