A bill to be entitled
2An act relating to liquefied petroleum gas; amending s.
3527.06, F.S.; prohibiting the Department of Agriculture
4and Consumer Services and other state agencies from
5requiring compliance with certain national standards for
6liquefied petroleum gas tanks unless the department or
7agencies require compliance with a specified edition of
8the national standards; amending s. 527.21, F.S.; revising
9the term "propane" for purposes of the Florida Propane Gas
10Education, Safety, and Research Act, to incorporate
11changes to certain national standards in a reference
12thereto; providing an effective date.

14Be It Enacted by the Legislature of the State of Florida:

16     Section 1.  Subsection (3) of section 527.06, Florida
17Statutes, is amended to read:
18     527.06  Rules.-
19     (3)(a)  Rules in substantial conformity with the published
20standards of the National Fire Protection Association (NFPA) are
21shall be deemed to be in substantial conformity with the
22generally accepted standards of safety concerning the same
23subject matter.
24     (b)  Notwithstanding any other law, the department or other
25state agency may not require compliance with the minimum
26separation distances of NFPA 58 for separation between a
27liquefied petroleum gas tank and a building, adjoining property
28line, other liquefied petroleum gas tank, or any source of
29ignition, except in compliance with the minimum separation
30distances of the 2011 edition of NFPA 58.
31     Section 2.  Subsection (11) of section 527.21, Florida
32Statutes, is amended to read:
33     527.21  Definitions relating to Florida Propane Gas
34Education, Safety, and Research Act.-As used in ss. 527.20-
35527.23, the term:
36     (11)  "Propane" includes propane, butane, mixtures, and
37liquefied petroleum gas as defined by the National Fire
38Protection Association (NFPA) Standard 58, For The Storage and
39Handling of Liquefied Petroleum Gas Code Gases.
40     Section 3.  This act shall take effect July 1, 2011.
