2 An act relating to the Public Employees Relations
3 Commission; amending s. 447.205, F.S.; requiring that
4 the commission be composed of a chair and two part
5 time members rather than two full-time members;
6 providing for the chair of the commission to remain as
7 a full-time appointment; prohibiting the part-time
8 members from engaging in any business, vocation, or
9 employment that conflicts with their duties while in
10 such office; providing an effective date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Subsection (1) of section 447.205, Florida
15 Statutes, is amended to read:
16 447.205 Public Employees Relations Commission.—
17 (1) The Public Employees Relations Commission, hereinafter
18 referred to as the “commission,” shall be composed of a chair
19 and two part-time full-time members to be appointed by the
20 Governor, subject to confirmation by the Senate, from persons
21 representative of the public and known for their objective and
22 independent judgment, who may shall not be employed by, or hold
23 any commission with, any governmental unit in the state or any
24 employee organization, as defined in this part, while in such
25 office. In no event shall more than one appointee be a person
26 who, on account of previous vocation, employment, or
27 affiliation, is, or has been, classified as a representative of
28 employers; and in no event shall more than one such appointee be
29 a person who, on account of previous vocation, employment, or
30 affiliation, is, or has been, classified as a representative of
31 employees or employee organizations. The chair of the commission
32 commissioners shall devote full time to commission duties and
33 may shall not engage in any other business, vocation, or
34 employment while in such office. The part-time members may not
35 engage in any business, vocation, or employment that conflicts
36 with their duties while in such office. Beginning January 1,
37 1980, the chair shall be appointed for a term of 4 years, one
38 commissioner for a term of 1 year, and one commissioner for a
39 term of 2 years. Thereafter, every term of office shall be for 4
40 years; and each term of the office of chair shall commence on
41 January 1 of the second year following each regularly scheduled
42 general election at which a Governor is elected to a full term
43 of office. If there is In the event of a vacancy before prior to
44 the expiration of a term of office, an appointment shall be made
45 for the unexpired term of that office. The chair is shall be
46 responsible for the administrative functions of the commission
47 and has shall have the authority to employ such personnel as may
48 be necessary to carry out the provisions of this part. Once
49 appointed to the office of chair, the chair shall serve as chair
50 for the duration of the term of office of chair. This section
51 does not prohibit Nothing contained herein prohibits a chair or
52 commissioner from serving multiple terms.
53 Section 2. This act shall take effect July 1, 2011.
