A bill to be entitled
2An act relating to water management district planning and
3budgeting; amending s. 373.089, F.S.; requiring the
4governing boards of water management districts to review
5lands to which the districts hold title and to make such
6lands available for purchase under certain conditions;
7requiring local government consent for the sale of certain
8lands; amending s. 373.536, F.S.; requiring approval by
9the Executive Office of the Governor for the transfer of
10funds within a water management district's final adopted
11budget; providing an effective date.

13Be It Enacted by the Legislature of the State of Florida:
14
15     Section 1.  Subsection (5) of section 373.089, Florida
16Statutes, is amended to read:
17     373.089  Sale or exchange of lands, or interests or rights
18in lands.-The governing board of the district may sell lands, or
19interests or rights in lands, to which the district has acquired
20title or to which it may hereafter acquire title in the
21following manner:
22     (5)(a)  Every 5 years, the governing board of the district
23shall conduct a review of lands to which the district holds
24title and determine which lands are not necessary for water
25management or conservation purposes. Such lands shall be made
26available for purchase through the surplusing process in this
27section if the lands will be reentered onto the ad valorem tax
28roll of the county in which the land is located. Lands acquired
29with matching funds from a local government may not be made
30available for purchase without the consent of the local
31government.
32     (b)  In any county having a population of 75,000 or fewer,
33or a county having a population of 100,000 or fewer that is
34contiguous to a county having a population of 75,000 or fewer,
35in which more than 50 percent of the lands within the county
36boundary are federal lands and lands titled in the name of the
37state, a state agency, a water management district, or a local
38government, those lands titled in the name of a water management
39district which are not essential or necessary to meet
40conservation purposes may, upon request of a public or private
41entity, be made available for purchase through the surplusing
42process in this section. Priority consideration must be given to
43buyers, public or private, who are willing to return the
44property to productive use so long as the property can be
45reentered onto the county ad valorem tax roll. Property acquired
46with matching funds from a local government shall not be made
47available for purchase without the consent of the local
48government.
49     Section 2.  Paragraph (a) of subsection (4) of section
50373.536, Florida Statutes, is amended to read:
51     373.536  District budget and hearing thereon.-
52     (4)  BUDGET CONTROLS.-
53     (a)  The final adopted budget for the district will
54thereupon be the operating and fiscal guide for the district for
55the ensuing year; however, if approved by the Executive Office
56of the Governor, a transfer transfers of funds may be made
57within the budget by action of the governing board at a public
58meeting of the governing board.
59     Section 3.  This act shall take effect July 1, 2011.
