| 8 | Be It Resolved by the Legislature of the State of Florida: |
| 9 |

| 10 | That the following creation of Section 22 of Article III of |
| 11 | the State Constitution is agreed to and shall be submitted to |
| 12 | the electors of this state for approval or rejection at the next |
| 13 | general election or at an earlier special election specifically |
| 14 | authorized by law for that purpose: |
| 15 | ARTICLE III |
| 16 | LEGISLATURE |
| 17 | SECTION 22. Death penalty.-Notwithstanding any other |
| 18 | provision of this constitution, the Legislature by general law |
| 19 | shall adopt rules governing time limits, procedures, and |
| 20 | processes relating to all death penalty cases and related |
| 21 | proceedings in all courts. |
| 22 | BE IT FURTHER RESOLVED that the following statement be |
| 23 | placed on the ballot: |
| 24 | CONSTITUTIONAL AMENDMENT |
| 25 | ARTICLE III, SECTION 22 |
| 26 | DEATH PENALTY CASES.-The State Constitution currently |
| 27 | provides that the Florida Supreme Court adopts rules for |
| 28 | practice and procedure for all state courts in all cases. |
| 29 | Proposing an amendment to the State Constitution to require the |
| 30 | Legislature by general law to adopt rules governing time limits, |
| 31 | procedures, and processes relating to all death penalty cases |
| 32 | and related proceedings in all courts. |
