    1                        A bill to be entitled                      
    2         An act relating to unclaimed deposits held by
    3         utilities; amending s. 717.108, F.S.; requiring that
    4         any unclaimed deposits held by a utility be deposited
    5         into the Energy Affordability Trust Fund within the
    6         Department of Community Affairs for the purpose of
    7         supplementing the Low Income Home Energy Assistance
    8         Program; providing a contingent effective date.

   10  Be It Enacted by the Legislature of the State of Florida:
   11  
   12         Section 1. Section 717.108, Florida Statutes, is amended to
   13  read:
   14         717.108 Deposits held by utilities.—Any deposit, including
   15  any interest thereon, made by a subscriber with a utility to
   16  secure payment or any sum paid in advance for utility services
   17  to be furnished, less any lawful charges, that remains unclaimed
   18  by the owner for more than 1 year after termination of the
   19  services for which the deposit or advance payment was made is
   20  presumed unclaimed. The unclaimed deposits shall be deposited
   21  into the Energy Affordability Trust Fund within the Department
   22  of Community Affairs for the purpose of supplementing the Low
   23  Income Home Energy Assistance Program.
   24         Section 2. This act shall take effect July 1, 2011, if SB
   25  ___ or similar legislation takes effect, if such legislation is
   26  enacted in the same legislative session, or an extension
   27  thereof, and becomes law.
