    1                        A bill to be entitled                      
    2         An act relating to trust funds; creating the Energy
    3         Affordability Trust Fund within the Department of
    4         Community Affairs; providing the purpose of the trust
    5         fund and the source of funds; providing for future
    6         review and termination or re-creation of the trust
    7         fund; providing an effective date.

    9  Be It Enacted by the Legislature of the State of Florida:
   10  
   11         Section 1. Energy Affordability Trust Fund.—
   12         (1) The Energy Affordability Trust Fund is created within
   13  the Department of Community Affairs.
   14         (2) The trust fund is established for use as a depository
   15  for funds to be used to supplement the Low Income Home Energy
   16  Assistance Program. Moneys to be credited to the trust fund
   17  shall consist of unclaimed deposits held by utilities pursuant
   18  to s. 717.108, Florida Statutes.
   19         (3) In accordance with s. 19(f)(2), Article III of the
   20  State Constitution, the Energy Affordability Trust Fund shall,
   21  unless terminated sooner, be terminated on July 1, 2015. Before
   22  its scheduled termination, the trust fund shall be reviewed as
   23  provided in s. 215.3206(1) and (2), Florida Statutes.
   24         Section 2. This act shall take effect July 1, 2011, but
   25  this act shall not take effect unless it is enacted by a three
   26  fifths vote of the membership of each house of the Legislature.
