| 9 | Be It Enacted by the Legislature of the State of Florida: |
| 10 |
|
| 11 | Section 1. Section 496.4145, Florida Statutes, is created |
| 12 | to read: |
| 13 | 496.4145 Unattended donation bins of charitable |
| 14 | organizations.- |
| 15 | (1) A charitable organization that operates one or more |
| 16 | unattended donation bins into which persons may donate to the |
| 17 | organization clothing or other personal property must comply |
| 18 | with the following: |
| 19 | (a) Each bin must have attached signage that clearly and |
| 20 | prominently displays the name of the charitable organization and |
| 21 | the organization's name, logo, trademark or service mark, local |
| 22 | physical address, telephone number, and e-mail address. |
| 23 | (b) The charitable organization must receive at least 50 |
| 24 | percent of the personal property deposited into the bins or, if |
| 25 | such property is processed and sold by another person or entity |
| 26 | that is a for-profit business, the charitable organization must |
| 27 | receive at least 50 percent of the proceeds from the sale of |
| 28 | such property. |
| 29 | (2) As used in this section, the term "unattended donation |
| 30 | bin" means a receptacle that is not located adjacent to or on |
| 31 | property where the charitable organization operates a facility |
| 32 | that is attended during business hours by employees or |
| 33 | volunteers of the organization. |
| 34 | Section 2. This act shall take effect July 1, 2011. |
