    1                        A bill to be entitled                      
    2         An act relating to compensation of county officials;
    3         amending ss. 145.031, 145.051, 145.071, 145.09,
    4         145.10, and 145.11, F.S.; authorizing each member of a
    5         board of county commissioners, each clerk of the
    6         circuit court, county comptroller, each sheriff, each
    7         supervisor of elections, each property appraiser, and
    8         each tax collector to reduce his or her salary on a
    9         voluntary basis; providing an effective date.

   11  Be It Enacted by the Legislature of the State of Florida:
   12  
   13  
   14         Section 1. Section 145.031, Florida Statutes, is amended to
   15  read:
   16         145.031 Board of county commissioners.—
   17         (1) Each member of the board of county commissioners shall
   18  receive as salary the amount indicated, based on the population
   19  of his or her county. In addition, compensation shall be made
   20  for population increments over the minimum for each population
   21  group, which shall be determined by multiplying the population
   22  in excess of the minimum for the grouping times the group rate.

   32         (2) No member of a governing body of a chartered county or
   33  a county with a consolidated form of government shall be deemed
   34  to be the equivalent of a county commissioner for the purposes
   35  of determining the compensation of such member under his or her
   36  respective charter.
   37         (3) Notwithstanding the provisions of this section or s.
   38  145.19, each member of the board of county commissioners may
   39  reduce his or her salary rate on a voluntary basis.
   40         Section 2. Section 145.051, Florida Statutes, is amended to
   41  read:
   42         145.051 Clerk of circuit court; county comptroller.—
   43         (1) Each clerk of the circuit court and each county
   44  comptroller shall receive as salary the amount indicated, based
   45  on the population of his or her county. In addition, a
   46  compensation shall be made for population increments over the
   47  minimum for each population group, which shall be determined by
   48  multiplying the population in excess of the minimum for the
   49  group times the group rate.

   58         (2)(a) There shall be an additional $2,000 per year special
   59  qualification salary for each clerk of the circuit court who has
   60  met the certification requirements established by the Supreme
   61  Court. Any clerk of the circuit court who is certified during a
   62  calendar year shall receive in that year a pro rata share of the
   63  special qualification salary based on the remaining period of
   64  the year.
   65         (b) In order to qualify for the special qualification
   66  salary provided by paragraph (a), the clerk must complete the
   67  requirements established by the Supreme Court within 6 years
   68  after first taking office.
   69         (c) After a clerk meets the requirements of paragraph (a),
   70  in order to remain certified the clerk shall thereafter be
   71  required to complete each year a course of continuing education
   72  as prescribed by the Supreme Court.
   73         (3) Notwithstanding the provisions of this section or s.
   74  145.19, each clerk of the circuit court and each county
   75  comptroller may reduce his or her salary rate on a voluntary
   76  basis.
   77         Section 3. Section 145.071, Florida Statutes, is amended to
   78  read:
   79         145.071 Sheriff.—
   80         (1) Each sheriff shall receive as salary the amount
   81  indicated, based on the population of his or her county. In
   82  addition, a compensation shall be made for population increments
   83  over the minimum for each group, which shall be determined by
   84  multiplying the population in excess of the minimum for the
   85  group times the group rate.

   94         (2)(a) There shall be an additional $2,000 per year special
   95  qualification salary for each sheriff who has met the
   96  qualification requirements established by the Department of Law
   97  Enforcement. Any sheriff who so qualifies during a calendar year
   98  shall receive in that year a pro rata share of the special
   99  qualification salary based on the remaining period of the year.
  100         (b) In order to qualify for the special qualification
  101  salary described in paragraph (a), the sheriff must complete the
  102  requirements specified in that paragraph within 6 years after
  103  first taking office.
  104         (c) After a sheriff meets the requirements of paragraph
  105  (a), in order to remain qualified the sheriff shall thereafter
  106  be required to complete each year a course of continuing
  107  education as prescribed by the Department of Law Enforcement.
  108         (3) Notwithstanding the provisions of this section or s.
  109  145.19, each sheriff may reduce his or her salary rate on a
  110  voluntary basis.
  111         Section 4. Section 145.09, Florida Statutes, is amended to
  112  read:
  113         145.09 Supervisor of elections.—
  114         (1) Each supervisor of elections shall receive as salary
  115  the amount indicated, based on the population of his or her
  116  county. In addition, a compensation shall be made for population
  117  increments over the minimum for each population group, which
  118  shall be determined by multiplying the population in excess of
  119  the minimum for the group times the group rate.

  128         (2) The above salaries are based upon a 5-day workweek. If
  129  a supervisor does not keep his or her office open 5 days per
  130  week, then the salary will be prorated accordingly.
  131         (3)(a) There shall be an additional $2,000 per year special
  132  qualification salary for each supervisor of elections who has
  133  met the certification requirements established by the Division
  134  of Elections of the Department of State. The Department of State
  135  shall adopt rules to establish the certification requirements.
  136  Any supervisor who is certified during a calendar year shall
  137  receive in that year a pro rata share of the special
  138  qualification salary based on the remaining period of the year.
  139         (b) In order to qualify for the special qualification
  140  salary described in paragraph (a), the supervisor must complete
  141  the requirements established by the Division of Elections within
  142  6 years after first taking office.
  143         (c) After a supervisor meets the requirements of paragraph
  144  (a), in order to remain certified the supervisor shall
  145  thereafter be required to complete each year a course of
  146  continuing education as prescribed by the division.
  147         (4) Notwithstanding the provisions of this section or s.
  148  145.19, each supervisor of elections may reduce his or her
  149  salary rate on a voluntary basis.
  150         Section 5. Section 145.10, Florida Statutes, is amended to
  151  read:
  152         145.10 Property appraiser.—
  153         (1) Each property appraiser shall receive as salary the
  154  amount indicated, based on the population of his or her county.
  155  In addition, a compensation shall be made for population
  156  increments over the minimum for each population group, which
  157  shall be determined by multiplying the population in excess of
  158  the minimum for the group times the group rate.

  167         (2)(a) There shall be an additional $2,000 per year special
  168  qualification salary for each property appraiser who has met the
  169  requirements of the Department of Revenue and has been
  170  designated a certified Florida property appraiser. Any property
  171  appraiser who is certified during a calendar year shall receive
  172  in that year a pro rata share of the special qualification
  173  salary based on the remaining period of the year. The department
  174  shall establish and maintain a certified Florida property
  175  appraiser program.
  176         (b) In order to qualify for the special qualification
  177  salary described in paragraph (a), the property appraiser must
  178  complete the requirements established by the Department of
  179  Revenue within 4 years after first taking office.
  180         (c) After a property appraiser meets the requirements of
  181  paragraph (a), in order to remain certified the property
  182  appraiser shall thereafter be required to complete each year a
  183  course of continuing education as prescribed by the department.
  184  The executive director of the Department of Revenue may, at his
  185  or her discretion, waive the requirements of this paragraph for
  186  any property appraiser who has reached 60 years of age and who
  187  has been a property appraiser for 20 years.
  188         (3) Notwithstanding the provisions of this section or s.
  189  145.19, each property appraiser may reduce his or her salary
  190  rate on a voluntary basis.
  191         Section 6. Section 145.11, Florida Statutes, is amended to
  192  read:
  193         145.11 Tax collector.—
  194         (1) Each tax collector shall receive as salary the amount
  195  indicated, based on the population of his or her county. In
  196  addition, a compensation shall be made for population increments
  197  over the minimum for each population group, which shall be
  198  determined by multiplying the population in excess of the
  199  minimum for the group times the group rate.

  208         (2)(a) There shall be an additional $2,000 per year special
  209  qualification salary for each tax collector who has met the
  210  requirements of the Department of Revenue and has been
  211  designated a certified Florida tax collector. Any tax collector
  212  who is certified during a calendar year shall receive in that
  213  year a pro rata share of the special qualification salary based
  214  on the remaining period of the year. The department shall
  215  establish and maintain a certified Florida tax collector
  216  program.
  217         (b) In order to qualify for the special qualification
  218  salary described in paragraph (a), the tax collector must
  219  complete the requirements established by the Department of
  220  Revenue within 4 years after first taking office.
  221         (c) After a tax collector meets the requirements of
  222  paragraph (a), in order to remain certified the tax collector
  223  shall thereafter be required to complete each year a course of
  224  continuing education as prescribed by the department.
  225         (3) Notwithstanding the provisions of this section or s.
  226  145.19, each tax collector may reduce his or her salary rate on
  227  a voluntary basis.
  228         Section 7. This act shall take effect July 1, 2011.
