    1                        A bill to be entitled                      
    2         An act relating to taxi operators; authorizing
    3         governmental units that regulate the operation of
    4         taxis to create a private property right in the
    5         license to operate a taxi; providing for the transfer
    6         of such property right; providing definitions;
    7         providing an effective date.

    9  Be It Enacted by the Legislature of the State of Florida:
   10  
   11         Section 1. (1) Any governmental unit that is authorized to
   12  regulate the operation of taxis within its geographic boundaries
   13  may adopt ordinances, rules, regulations, orders, or other acts
   14  that create a private property right or interest in a license to
   15  operate a taxi within the geographic boundaries of the
   16  governmental unit.
   17         (2) Upon the creation of such private property right, the
   18  owner of a taxi operation may pledge, sell, assign, sublease, or
   19  otherwise transfer the license to another person. However, the
   20  owner must apply to the governmental unit before making such
   21  transfer and obtain its approval for the proposed action, except
   22  that a license may be transferred by operation of intestate
   23  succession or devise.
   24         (3) As used in this section, the term:
   25         (a) “License” includes any certificate, permit, medallion,
   26  or other evidence that authorizes a person to operate a taxi
   27  within the geographic boundaries of a governmental unit.
   28         (b) “Governmental unit” includes a county, municipality,
   29  special district, commission, or other unit of state or local
   30  government.
   31         Section 2. This act shall take effect July 1, 2011.
