       The Committee on Transportation (Benacquisto) recommended the
       following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 48 - 50
    4  and insert:
    5  (5) A first violation of this section is a noncriminal traffic
    6  infraction, punishable as a nonmoving violation as provided in
    7  chapter 318. A second or subsequent violation of this section is
    8  a noncriminal traffic infraction punishable as a moving
    9  violation as provided in chapter 318.

   14  and insert:
   15         providing that a second or subsequent violation is a
   16         moving violation
