A bill to be entitled
2An act relating to state parks; amending s. 258.0145,
3F.S.; providing for the parents of certain deceased
4veterans and the spouse and parents of law enforcement
5officers and firefighters who die in the line of duty to
6receive annual entrance passes to state parks at no
7charge; amending s. 380.0685, F.S., relating to a
8surcharge imposed on admission fees to state parks in
9areas of critical state concern located in certain
10counties; providing for certain municipalities to use the
11proceeds of the surcharge for land acquisition or beach
12renourishment or restoration; providing limitations for
13purposes of determining state matching funds; exempting
14the state from specified liability provisions with respect
15to parks within the state park system that have free-
16roaming animal populations; designating Jack Mashburn
17Marina in Bay County; directing the Department of
18Environmental Protection to erect suitable markers;
19providing an effective date.

21Be It Enacted by the Legislature of the State of Florida:
22
23     Section 1.  Subsection (3) of section 258.0145, Florida
24Statutes, is amended, and subsection (4) is added to that
25section, to read:
26     258.0145  Military state park fee discounts.-The Division
27of Recreation and Parks shall provide the following discounts on
28park fees to persons who present written documentation
29satisfactory to the division which evidences their eligibility
30for the discounts:
31     (3)  Surviving spouses and parents of deceased members of
32the United States Armed Forces, National Guard, or reserve
33components thereof who have fallen in combat shall receive
34lifetime family annual entrance passes at no charge.
35     (4)  The surviving spouse and parents of a law enforcement
36officer, as defined in s. 943.10(1), or a firefighter, as
37defined in s. 633.30(1), who has died in the line of duty shall
38receive lifetime family annual entrance passes at no charge.
39     Section 2.  Section 380.0685, Florida Statutes, is amended
40to read:
41     380.0685  State park in area of critical state concern in
42county which creates land authority; surcharge on admission and
43overnight occupancy.-The Department of Environmental Protection
44shall impose and collect a surcharge of 50 cents per person per
45day, or $5 per annual family auto entrance permit, on admission
46to all state parks in areas of critical state concern located in
47a county which creates a land authority pursuant to s.
48380.0663(1), and a surcharge of $2.50 per night per campsite,
49cabin, or other overnight recreational occupancy unit in state
50parks in areas of critical state concern located in a county
51which creates a land authority pursuant to s. 380.0663(1);
52however, no surcharge shall be imposed or collected under this
53section for overnight use by nonprofit groups of organized group
54camps, primitive camping areas, or other facilities intended
55primarily for organized group use. Such surcharges shall be
56imposed within 90 days after any county creating a land
57authority notifies the Department of Environmental Protection
58that the land authority has been created. The proceeds from such
59surcharges, less a collection fee that shall be kept by the
60Department of Environmental Protection for the actual cost of
61collection, not to exceed 2 percent, shall be transmitted to the
62land authority of the county from which the revenue was
63generated. Such funds shall be used to purchase property in the
64area or areas of critical state concern in the county from which
65the revenue was generated. An amount not to exceed 10 percent
66may be used for administration and other costs incident to such
67purchases. However, the proceeds of the surcharges imposed and
68collected pursuant to this section in a state park or parks
69located wholly within a municipality, less the costs of
70collection as provided herein, shall be transmitted to that
71municipality for use by the municipality for land acquisition or
72for beach renourishment or restoration, including, but not
73limited to, costs associated with any design, permitting,
74monitoring, and mitigation of such work, as well as the work
75itself. However, these funds may not be included in any
76calculation used for providing state matching funds for local
77contributions for beach renourishment or restoration. The
78surcharges levied under this section shall remain imposed as
79long as the land authority is in existence.
80     Section 3.  The state is exempt from the provisions of s.
81588.15, Florida Statutes, with respect to any property within
82the state park system that has free-roaming animal populations.
83     Section 4.  Jack Mashburn Marina designated; Department of
84Environmental Protection to erect suitable markers.-
85     (1)  The marina commonly referred to as the "boat basin" on
86Grand Lagoon at St. Andrews State Park in Bay County is
87designated as "Jack Mashburn Marina."
88     (2)  The Department of Environmental Protection is directed
89to erect suitable markers designating Jack Mashburn Marina as
90described in subsection (1).
91     Section 5.  This act shall take effect July 1, 2011.
