1 A bill to be entitled
2 An act relating to employment practices; prohibiting
3 the use of a job applicant’s personal credit history
4 as a hiring criterion; providing an exception;
5 providing an effective date.

7 Be It Enacted by the Legislature of the State of Florida:

9 Section 1. (1) Except where required by law, it is an
10 improper employment practice for an employer to directly or
11 indirectly use a job applicant’s personal credit history as a
12 hiring criterion.
13 (2) Notwithstanding subsection (1), an employer may request
14 a credit history background check as part of the application
15 process if such history is shown to be directly related to the
16 position sought by the applicant. However, such history may not
17 be the determining factor in whether the applicant is ultimately
18 hired to the position sought.
19 Section 2. This act shall take effect July 1, 2012.
