    1                        A bill to be entitled                      
    2         An act relating to public food service establishments;
    3         creating s. 509.234, F.S.; requiring public food
    4         service establishments to serve sugar-free substitutes
    5         for certain syrups, jelly, jam, marmalade, and fruit
    6         preserves and provide notice to guests of the
    7         availability of such sugar-free substitutes; providing
    8         requirements for such notice; providing an effective
    9         date.

   11  Be It Enacted by the Legislature of the State of Florida:
   12  
   13         Section 1. Section 509.234, Florida Statutes, is created to
   14  read:
   15         509.234 Sugar-free substitutes for syrups, jelly, jam,
   16  marmalade, and fruit preserves; notice to guests.—A public food
   17  service establishment that serves pancake or waffle syrup or any
   18  jelly, jam, marmalade, or fruit preserves must:
   19         (1) Serve a sugar-free substitute for such syrup, jelly,
   20  jam, marmalade, or fruit preserves.
   21         (2) Provide notice to guests of the availability of such
   22  sugar-free syrup, jelly, jam, marmalade, or fruit preserves. The
   23  notice must be included on the establishment’s food menu and
   24  displayed prominently at any area of the establishment where any
   25  foods served with such syrup, jelly, jam, marmalade, or fruit
   26  preserves are advertised for sale, including, but not limited
   27  to, the posting of daily specials, an overhead menu posted at a
   28  food service counter, an outdoor menu posted for guests using a
   29  drive-through service window, and any signage posted at the
   30  establishment.
   31         Section 2. This act shall take effect July 1, 2012.
