       The Committee on Health Regulation (Diaz de la Portilla)
       recommended the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 263 and 264
    4  insert:
    5         Section 4. Paragraph (b) of subsection (5) of section
    6  893.055, Florida Statutes, is amended to read:
    7         893.055 Prescription drug monitoring program.—
    8         (5) When the following acts of dispensing or administering
    9  occur, the following are exempt from reporting under this
   10  section for that specific act of dispensing or administration:
   11         (b) A pharmacist or health care practitioner when
   12  administering a controlled substance to a patient who is
   13  receiving hospice care or to a patient or resident receiving
   14  care as a patient at a hospital, nursing home, ambulatory
   15  surgical center, hospice, or intermediate care facility for the
   16  developmentally disabled which is licensed in this state.

   19         And the title is amended as follows:
   20         Delete line 19
   21  and insert:
   22         board-certified psychiatrist or rheumatologist;
   23         amending s. 893.055, F.S.; providing that a pharmacist
   24         or health care practitioner is exempt from reporting a
   25         dispensed controlled substance to the Department of
   26         Health when administering the controlled substance to
   27         a patient who is receiving hospice care or to a
   28         patient or resident receiving care at certain medical
   29         facilities licensed in this state;
