1 A bill to be entitled
2 An act relating to trust funds; creating s. 766.410,
3 F.S.; creating the Patient Compensation Trust Fund
4 within the State Treasury; providing for the purpose
5 and sources of funds of the trust fund; providing for
6 future review and termination or re-creation of the
7 trust fund; providing a directive to the Division of
8 Statutory Revision to place s. 766.410, F.S., in part
9 IV of ch. 766, F.S.; providing a contingent effective
10 date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Section 766.410, Florida Statutes, is created to
15 read:
16 766.410 Patient Compensation Trust Fund.—
17 (1) There is created in the State Treasury a special fund
18 to be designated as the Patient Compensation Trust Fund, which
19 shall be used in the operation of the Patient Compensation
20 System in the performance of the various functions and duties
21 required of it under this part. The trust fund is established
22 for the deposit of contributions required to be paid by
23 providers pursuant to s. 766.408.
24 (2) Notwithstanding s. 216.301 and pursuant to s. 216.351,
25 any balance in the trust fund at the end of any fiscal year
26 shall remain in the trust fund at the end of the year and shall
27 be available for carrying out the purposes of the trust fund.
28 (3) In accordance with s. 19(f)(2), Art. III of the State
29 Constitution, the trust fund shall, unless terminated sooner, be
30 terminated on July 1, 2016. Before its scheduled termination,
31 the trust fund shall be reviewed as provided in s. 215.3206(1)
32 and (2).
33 Section 2. The Division of Statutory Revision is directed
34 to place section 766.410, Florida Statutes, as created by this
35 act in part IV of chapter 766, Florida Statutes.
36 Section 3. This act shall take effect on the same date that
37 SB ____ or similar legislation takes effect, if such legislation
38 is enacted in the same legislative session, or an extension
39 thereof, and becomes law, and only if this act is enacted by a
40 three-fifths vote of the membership of each house of the
41 Legislature.
