       Senator Gaetz moved the following:
       
    1         Senate Amendment 
    2  
    3         Delete lines 515 - 533
    4  and insert:
    5         (22) If the governing board elects to sell or lease any
    6  physical property of a county, district, or municipal hospital
    7  or health care system and such property generated less than 20
    8  percent of the hospital’s net revenue within the hospital’s or
    9  health care system’s most recent fiscal year, the sale or lease
   10  of such property is exempt from the requirements under
   11  subsections (6)-(17). However, the governing board shall
   12  publicly advertise the meeting at which the proposed sale or
   13  lease of such property will be considered by the governing board
   14  of the hospital in accordance with s. 286.0105 or publicly
   15  advertise the offer to accept proposals in accordance with s.
   16  255.0525 and receive proposals from all qualified purchasers and
   17  lessees. The sale or lease of the property must be for fair
   18  market value or, if a lease is for less than fair market value,
   19  the lease must be in the best interest of the affected
   20  community.
   21         (23) A county, district or municipal hospital or health
   22  care system that is under lease as of the effective date of this
   23  act is not subject to subsections (5)-(17) as long as that lease
