       Senator Richter moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 1390 and 1391
    4  insert:
    5         Section 9. Section 627.7405, Florida Statutes, is amended
    6  to read:
    7         627.7405 Insurers’ right of reimbursement.—
    8         (1) Notwithstanding any other provisions of ss. 627.730
    9  627.7405, an any insurer providing personal injury protection
   10  benefits on a private passenger motor vehicle shall have, to the
   11  extent of any personal injury protection benefits paid to any
   12  person as a benefit arising out of such private passenger motor
   13  vehicle insurance, a right of reimbursement against the owner or
   14  the insurer of the owner of a commercial motor vehicle, if the
   15  benefits paid result from such person having been an occupant of
   16  the commercial motor vehicle or having been struck by the
   17  commercial motor vehicle while not an occupant of any self
   18  propelled vehicle.
   19         (2) The insurer’s right of reimbursement under this section
   20  does not apply to the owner or registrant of a motor vehicle
   21  used as a taxicab as identified in s. 627.733(1)(b).

   26  and insert:

   28         providing an exception from an insurer’s right of

   30         amending s. 817.234, F.S.;
