       The Committee on Health Regulation (Garcia) recommended the
       following:
       
    1         Senate Amendment 
    2  
    3         Delete lines 3349 - 3359
    4  and insert:
    5         Section 79. Effective upon this act becoming law paragraph
    6  (3) is added to subsection (1) of section 409.975. Before the
    7  selection of managed care plans as specified in s. 409.966, each
    8  essential provider and each hospital that are necessary in order
    9  for managed care plan to demonstrate an adequate network, as
   10  determined by the agency, are a part of that managed care plan’s
   11  network for purposes of the provider’s or hospital’s application
   12  for enrollment or expansion in the Medicaid program. A managed
   13  care plan’s payment under this section to an essential provider
   14  must be made in accordance with this section.
