       The Committee on Budget (Thrasher) recommended the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 221 and 222
    4  insert:
    5         (9) The contractor shall reimburse the state for the total
    6  cost of unused, accumulated leave actually paid by the state, in
    7  accordance with the law and policies in effect on January 1,
    8  2012, to former employees of the Department of Corrections who
    9  were employed at the correctional facilities and assigned
   10  correctional units included in the contract during the pay
   11  period immediately prior to the date on which the contractor
   12  begins performance. The total amount that must be reimbursed may
   13  not exceed $8 million under all contracts entered into pursuant
   14  to this section. The Department of Management Services shall
   15  certify to the contractor the amount that must be reimbursed and
   16  the contractor shall pay the reimbursement to the state no later
   17  than 180 days after receipt of such certification.

   20         And the title is amended as follows:
   21         Between lines 44 and 45
   22  insert:
   23         requiring that the contractor reimburse the state for
   24         the total cost of unused, accumulated leave actually
   25         paid by the state to former employees of the
   26         Department of Corrections who were employed at the
   27         correctional facilities and assigned correctional
   28         units; requiring that the Department of Management
   29         Services certify to the contractor the amount that
   30         must be reimbursed; requiring that the contractor pay
   31         the reimbursement to the state within a specified
   32         period after receiving the department’s certification;
