       The Committee on Criminal Justice (Bennett) recommended the
       following:
       
    1         Senate Amendment (with title amendment)

    3  
    4         Delete lines 43 - 47
    5  and insert:
    6         (3) A right of action for civil damages shall exist under
    7  s. 768.19, under all circumstances, for all deaths described in
    8  this section. However, this section does not create, expand or
    9  authorize any civil cause of action for negligence or wrongful
   10  death in any fetus that is not born alive, except as provided by
   11  this section for vehicular homicide.

   14         And the title is amended as follows:
   15         Delete line 7
   16  and insert:
   17         “viable fetus”; providing that the right of action for
   18         civil damages does not expand or authorize any civil

   21         vehicular homicide; amending
