| 7 | Be It Enacted by the Legislature of the State of Florida: |
| 8 |
|
| 9 | Section 1. Present subsection (9) of section 810.145, |
| 10 | Florida Statutes, is renumbered as subsection (10), a new |
| 11 | subsection (9) is added, and subsection (6) of that section is |
| 12 | amended, to read: |
| 13 | 810.145 Video voyeurism.- |
| 14 | (6) Except as provided in subsections (7), (8), and |
| 15 | (9)(8), a person who violates this section commits a misdemeanor |
| 16 | of the first degree, punishable as provided in s. 775.082 or s. |
| 17 | 775.083. |
| 18 | (9) A person who commits the offense of video voyeurism |
| 19 | within a residential dwelling commits a felony of the third |
| 20 | degree, punishable as provided in s. 775.082, s. 775.083, or s. |
| 21 | 775.084. |
| 22 | (10)(9) For purposes of this section, a person has |
| 23 | previously been convicted of or adjudicated delinquent for a |
| 24 | violation of this section if the violation resulted in a |
| 25 | conviction that was sentenced separately, or an adjudication of |
| 26 | delinquency entered separately, prior to the current offense. |
| 27 | Section 2. This act shall take effect July 1, 2012. |
