| 12 | hair removal or reduction under practice protocols who |
| 13 | are not licensed physicians or osteopathic physicians; |
| 14 | providing an effective date. |

| 16 | Be It Enacted by the Legislature of the State of Florida: |
| 17 |
|
| 18 | Section 1. Subsection (6) is added to section 478.42, |
| 19 | Florida Statutes, to read: |
| 20 | 478.42 Definitions.-As used in this chapter, the term: |
| 21 | (6) "Indirect supervision" means supervision of an |
| 22 | electrologist by a physician who is not on the premises but |
| 23 | practices at a location within 20 miles or 30 minutes of the |
| 24 | practice location of the supervised electrologist and is readily |
| 25 | available for consultation as needed. |
| 26 | Section 2. Section 478.451, Florida Statutes, is created |
| 27 | to read: |
| 28 | 478.451 Formal supervisory relationships.- |
| 29 | (1) A person licensed as an electrologist under this |
| 30 | chapter who performs hair removal or reduction using laser or |
| 31 | light-based technology must practice under a protocol with a |
| 32 | physician licensed under chapter 458 or chapter 459. |
| 33 | (2) All protocols relating to electrolysis or electrology |
| 34 | using laser or light-based hair removal or reduction must |
| 35 | require the licensed electrologist to be appropriately trained |
| 36 | and work under the indirect supervision of a physician licensed |
| 37 | under chapter 458 or chapter 459. |
| 38 | Section 3. Subsection (3) of section 458.348, Florida |
| 39 | Statutes, is amended to read: |
| 40 | 458.348 Formal supervisory relationships, standing orders, |
| 41 | and established protocols; notice; standards.- |
| 42 | (3) PROTOCOLS RELATING TO LASER OR LIGHT-BASED HAIR |
| 43 | REMOVAL OR REDUCTION REQUIRING DIRECT SUPERVISION.-All protocols |
| 44 | relating to electrolysis or electrology using laser or light- |
| 45 | based hair removal or reduction by persons other than physicians |
| 46 | licensed under this chapter or chapter 459 shall require the |
| 47 | person performing such service to be appropriately trained and |
| 48 | work only under the direct supervision and responsibility of a |
| 49 | physician licensed under this chapter or chapter 459. The |
| 50 | supervisory physician under the protocol is not required to be |
| 51 | onsite when the service is performed. |
| 52 | Section 4. Subsection (2) of section 459.025, Florida |
| 53 | Statutes, is amended to read: |
| 54 | 459.025 Formal supervisory relationships, standing orders, |
| 55 | and established protocols; notice; standards.- |
| 56 | (2) PROTOCOLS RELATING TO LASER OR LIGHT-BASED HAIR |
| 57 | REMOVAL OR REDUCTION REQUIRING DIRECT SUPERVISION.-All protocols |
| 58 | relating to electrolysis or electrology using laser or light- |
| 59 | based hair removal or reduction by persons other than |
| 60 | osteopathic physicians licensed under this chapter or chapter |
| 61 | 458 shall require the person performing such service to be |
| 62 | appropriately trained and to work only under the direct |
| 63 | supervision and responsibility of a an osteopathic physician |
| 64 | licensed under this chapter or chapter 458. The supervisory |
| 65 | physician under the protocol is not required to be onsite when |
| 66 | the service is performed. |
| 67 | Section 5. This act shall take effect upon becoming a law. |
