The Committee on Budget (Bogdanoff) recommended the following:

4 insert:
5 Section 2. Paragraph (a) of subsection (1) of section
6 39.201, Florida Statutes, is amended to read:
7 39.201 Mandatory reports of child abuse, abandonment, or
8 neglect; mandatory reports of death; central abuse hotline.—
9 (1)(a) Any person who knows, or has reasonable cause to
10 suspect, that a child is abused, abandoned, or neglected by a
11 parent, legal custodian, caregiver, or other person responsible
12 for the child’s welfare, as defined in this chapter, or that a
13 child is in need of supervision and care and has no parent,
14 legal custodian, or responsible adult relative immediately known
15 and available to provide supervision and care shall report such
16 knowledge or suspicion to the department in the manner
17 prescribed in subsection (2). However, a reporter listed in
18 subparagraph (b)1. or 2. shall, before making a report, make a
19 reasonable attempt to contact the prescribing physician, if any,
20 to determine if a test, administered at birth, which indicated
21 that the child’s blood, urine, or meconium contained the
22 presence of a controlled substance that is a prescription drug,
23 as defined in chapter 499, or metabolites of such substances,
24 was the result of legitimate medical treatment administered to
25 the mother or the newborn infant.

28 And the title is amended as follows:
29 Delete line 13
30 and insert:
31 Legislature; amending s. 39.201, F.S.; requiring
32 certain persons who report children who are suspected
33 of being abused, abandoned, or neglected, to attempt
34 to determine if certain tests administered to the
35 child at birth indicated the presence of a controlled
36 substance; requiring the reporter to make a reasonable
37 attempt to contact the prescribing physician to
38 determine if the presence of a controlled substance
39 was a result of a legitimate medical treatment;
40 providing an effective date.
