| 11 | Be It Enacted by the Legislature of the State of Florida: |
| 12 |

| 13 | Section 1. Section 798.01, Florida Statutes, is repealed. |
| 14 | Section 2. Section 798.02, Florida Statutes, is amended to |
| 15 | read: |
| 16 | 798.02 Lewd and lascivious behavior.-If Any man and woman, |
| 17 | not being married to each other, lewdly and lasciviously |
| 18 | associate and cohabit together, or if any man or woman, married |
| 19 | or unmarried, who engage engages in open and gross lewdness and |
| 20 | lascivious behavior with each other each commit, they shall be |
| 21 | guilty of a misdemeanor of the second degree, punishable as |
| 22 | provided in s. 775.082 or s. 775.083. |
| 23 | Section 3. This act shall take effect upon becoming a law. |
