       The Committee on Judiciary (Richter) recommended the following:
       
    1         Senate Amendment 
    2  
    3         Delete lines 155 - 160
    4  and insert:
    5  its own opinions and orders for the purpose of making the same
    6  accord with law and justice. Accordingly, an appellate court has
    7  the power to recall its own mandate for the purpose of allowing
    8  it to exercise such jurisdiction and power in a proper case. A
    9  mandate may not be recalled more than 120 days after it is
   10  issued.
