       Senator Evers moved the following:
       
    1         Senate Amendment (with title amendment)

    3         Between lines 41 and 42
    4  insert:
    5         Section 1. Subsection (3) is added to section 319.28,
    6  Florida Statutes, to read:
    7         319.28 Transfer of ownership by operation of law.—
    8         (3) A dealer of farm or industrial equipment who conducts a
    9  repossession, as defined in s. 493.6101(22), of such equipment
   10  is not subject to licensure as a recovery agent or recovery
   11  agency if the dealer is regularly engaged in the sale of the
   12  equipment for a particular manufacturer, if the lender is
   13  affiliated with that manufacturer, and if the dealer uses his or
   14  her own employees to conduct the repossession. The dealer may
   15  repossess such equipment only if it can be done without breach
   16  of the peace after reviewing the information provided by the
   17  lender and confirming that the borrower’s name and any
   18  identification or serial number of the equipment being
   19  repossessed matches such information.
