       Senator Evers moved the following:
       
    1         Senate Amendment (with title amendment)

    4  insert:
    5         Section 6. Road marking materials.—
    6         (1) A county, municipality, local governing authority, or
    7  other political subdivision of this state may not cause or allow
    8  markings to be placed on a street, roadway, or highway under its
    9  jurisdiction which are made with paint that has been mixed, in
   10  whole or in part, with reflective glass beads that contain 75
   11  parts per million or more of inorganic arsenic as determined
   12  using EPA Method 6010B in conjunction with EPA Method 3052 for
   13  sample preparation.
   14         (2) A person may not manufacture, sell, offer for sale, or
   15  offer for promotional purposes in this state reflective glass
   16  beads that are used to reflect light when applied to markings on
   17  a street, roadway, or highway in this state if the glass beads
   18  contain 75 parts per million or more of inorganic arsenic as
   19  determined by using EPA Method 6010B in conjunction with EPA
   20  Method 3052 for sample preparation.
   21         (3) A person who violates this section is subject to a
   22  civil penalty of at least $500 but not more than $1,000 for each
   23  violation. If the violation is of a continuing nature, each day
   24  of continuing violation is a separate offense.
