    1                        A bill to be entitled                      
    2         An act relating to trust funds; creating s. 29.32,
    3         F.S.; creating the Core Court System Clearing Trust
    4         Fund to be administered by the Chief Financial Officer
    5         as a clearing trust fund that is not subject to
    6         termination pursuant to s. 19(f), Art. III of the
    7         State Constitution; providing for sources of moneys
    8         and purposes; providing a contingent effective date.

   10  Be It Enacted by the Legislature of the State of Florida:
   11  
   12         Section 1. Section 29.32, Florida Statutes, is created to
   13  read:
   14         29.32 Core Court System Clearing Trust Fund.—
   15         (1) The Core Court System Clearing Trust Fund is created as
   16  a clearing fund for disbursing court-related revenue, as defined
   17  in s. 29.31, to the state courts system, the offices of the
   18  clerks of the circuit court, and the Court Education Trust Fund,
   19  and shall be administered by the Chief Financial Officer. Moneys
   20  credited to the trust fund shall be used for the purpose of
   21  funding the activities of the core court system, as defined in
   22  s. 29.31, and such other purposes as allowed by law. Any
   23  transfers or distributions from the trust fund shall be in
   24  accordance with the priority provisions of s. 29.31(4).
   25         (2) In accordance with s. 19(f)(3), Art. III of the State
   26  Constitution, the Core Court System Clearing Trust Fund is a
   27  clearing trust fund of the Chief Financial Officer and is not
   28  subject to termination.
   29         Section 2. This act shall take effect July 1, 2012, if
   30  Senate Bill ____ or similar legislation is adopted in the same
   31  legislative session, or an extension thereof, and becomes law,
   32  but this act shall not take effect unless enacted by a three
   33  fifths vote of the membership of each house of the Legislature.
