    1                        A bill to be entitled                      
    2         An act relating to environmental rules; providing that
    3         certain rules adopted by the Environmental Regulation
    4         Commission are legislatively ratified; providing
    5         applicability; providing an effective date.

    7  Be It Enacted by the Legislature of the State of Florida:
    8  
    9         Section 1. Pursuant to s. 120.541(3), Florida Statutes, the
   10  rule amendments to chapters 62-302 and 62-303, Florida
   11  Administrative Code, adopted by the Environmental Regulation
   12  Commission on December 8, 2011, are ratified.
   13         Section 2. This act serves no other purpose except as
   14  stated in section 1 of this act and may not be codified in the
   15  Florida Statutes. After this act becomes law, it’s enactment and
   16  effective dates shall be noted in the Florida Administrative
   17  Code or the Florida Administrative Weekly or both, as
   18  appropriate. The ratification does not alter rulemaking
   19  authority delegated by prior law, does not constitute
   20  legislative preemption of or exception to any provision of law
   21  governing adoption or enforcement of the rules cited, and is
   22  intended to preserve the status of any cited rule as a rule
   23  under chapter 120, Florida Statutes. The ratification does not
   24  cure any rulemaking defect or preempt any challenge based on a
   25  lack of authority or a violation of the legal requirements
   26  governing the adoption of the rule cited.
   27         Section 3. This act shall take effect upon becoming a law.
