       The Committee on Budget Subcommittee on General Government
       Appropriations (Latvala) recommended the following:
       
    1         Senate Amendment 
    2  
    3         Delete lines 87 - 106
    4  and insert:
    5         (5) Notwithstanding the provisions of subsection (1), a
    6  solid waste landfill closure account is created within the Solid
    7  Waste Management Trust Fund to provide funding for the closing
    8  and long-term care of solid waste management facilities. The
    9  department may use funds from the account to contract with a
   10  third party for the closing and long-term care of solid waste
   11  management facilities, if:
   12         (a) The facility had or has a department permit to operate
   13  the facility;
   14         (b) The permittee provided proof of financial assurance for
   15  closure in the form of an insurance certificate;
   16         (c) The facility has been deemed to be abandoned or has
   17  been ordered to close by the department;
   18         (d) Closure will be accomplished in substantial accordance
   19  with a closure plan approved by the department; and
   20         (e) The department has written documentation that the
   21  insurance company issuing the closure insurance policy will
   22  provide or reimburse most or all of the funds required to
   23  complete closing and long-term care of the facility.

   25  The department shall deposit the funds received from the
   26  insurance company as reimbursement for the costs of closing or
   27  long-term care of the facility into the solid waste landfill
   28  closure account.
