Section 486.0715, Florida Statutes, is created 6 to read: 7 486.0715 Physical therapist; issuance of temporary permit.— 8 (1) The board shall issue a temporary physical therapist 9 permit to an applicant who meets the following requirements: 10 (a) Completes an application for a temporary permit on a 11 form approved by the department. 12 (b) Meets all the eligibility requirements for licensure 13 under chapter 456, s. 486.031, and related rules, except passage 14 of a national examination approved by the board is not required. 15 (c) Submits an application for licensure under s. 486.041. 16 (d) Demonstrates proof of possessing malpractice insurance. 17 (e) Submits documentation, under rules adopted by the 18 board, verifying that the applicant will practice under the 19 direct supervision of a licensed physical therapist as provided 20 in subsection (3). 21 (2) A temporary permit is not renewable and is valid until 22 a license is granted by the board. A temporary permit is void if 23 the permittee does not pass or sit for a national examination 24 approved by the board within 6 months after the date of 25 graduation from a physical therapy training program. 26 (3) An applicant for a temporary permit may not work as a 27 physical therapist until a temporary permit is issued by the 28 board. A physical therapist who is practicing under a temporary 29 permit must do so under the direct supervision of a licensed 30 physical therapist. A supervising physical therapist shall 31 supervise only one permittee at any given time. The supervising 32 physical therapist must be licensed for a minimum of 6 months 33 before the supervision period begins and must cosign all patient 34 records produced by the physical therapist who is practicing 35 under a temporary permit. 36 Section 2. Section 486.1065, Florida Statutes, is created 37 to read: 38 486.1065 Physical therapist assistant; issuance of 39 temporary permit.— 40 (1) The board shall issue a temporary physical therapist 41 assistant permit to an applicant who meets the following 42 requirements: 43 (a) Completes an application for a temporary permit on a 44 form approved by the department. 45 (b) Is a graduate of an approved United States physical 46 therapy educational program and meets all the eligibility 47 requirements for licensure under ch. 456, s. 486.031(1)-(3)(a), 48 and related rules, except passage of a national examination 49 approved by the board is not required. 50 (c) Submits an application for licensure under s. 486.103. 51 (d) Demonstrates proof of possessing malpractice insurance. 52 (e) Submits documentation, under rules adopted by the 53 board, verifying that the applicant will practice under the 54 direct supervision of a licensed physical therapist as provided 55 in subsection (3). 56 (2) A temporary permit is not renewable and is valid until 57 a license is granted by the board. Subsection (1) of section 486.151, Florida 72 Statutes, is amended to read: 73 486.151 Prohibited acts; penalty.— 74 (1) It is unlawful for any person to: 75 (a) Practice physical therapy or attempt to practice 76 physical therapy without an active license or temporary permit. 77 (b) Use or attempt to use a license or temporary permit to 78 practice physical therapy which is suspended,orrevoked, or 79 void. 80 (c) Obtain or attempt to obtain a license or temporary 81 permit to practice physical therapy by fraudulent 82 misrepresentation. 83 (d) Use the name or title “Physical Therapist” or “Physical 84 Therapist Assistant” or any other name or title which would lead 85 the public to believe that the person using the name or title is 86 licensed to practice physical therapy, unless such person holds 87 a valid license. 88 (e) Make any willfully false oath or affirmation whenever 89 an oath or affirmation is required by this chapter. 90 (f) Knowingly conceal information relating to violations of 91 this chapter. 92 Section 4. This act shall take effect June 1, 2012. 93 94 ================= T I T L E A M E N D M E N T ================ 95 And the title is amended as follows: 96 Delete everything before the enacting clause 97 and insert: 98 A bill to be entitled 99 An act relating to physical therapy; creating ss. 100 486.0715 and 486.1065, F.S.; authorizing issuance of a 101 temporary permit to practice as a physical therapist 102 or physical therapist assistant; providing 103 requirements for issuing a temporary permit; providing 104 for voiding of a temporary permit; providing 105 requirements for the supervision of temporary 106 permittees; amending s. 486.151, F.S.; prohibiting 107 certain acts concerning temporary permits; providing 108 an effective date.
