| 3 | creating s. 501.1425, F.S.; encouraging retail sales |

| 5 | external defibrillator; requiring training, |
| 6 | maintenance, and location registration; providing |
| 7 | immunity from liability under the Good Samaritan Act |
| 8 | and the Cardiac Arrest Survival Act; authorizing the |
| 9 | Department of Business and Professional Regulation to |
| 10 | adopt rules; providing an effective date. |

| 12 | Be It Enacted by the Legislature of the State of Florida: |
| 13 |
|
| 14 | Section 1. Section 501.1425, Florida Statutes, is created |
| 15 | to read: |
| 16 | 501.1425 Defibrillators in retail sales establishments.- |
| 17 | (1) Each retail sales establishment is encouraged to have |
| 18 | on the premises at all times a functioning automated external |
| 19 | defibrillator. |
| 20 | (2) Retail sales establishments that provide automated |
| 21 | external defibrillators shall ensure that employees and |
| 22 | volunteers are properly trained in accordance with s. 401.2915. |
| 23 | (3) The location of each automated external defibrillator |
| 24 | shall be registered with a local emergency medical services |
| 25 | medical director. |
| 26 | (4) The use of automated external defibrillators by |
| 27 | employees and volunteers shall be covered under the provisions |
| 28 | of ss. 768.13 and 768.1325. |
| 29 | (5) The Department of Business and Professional Regulation |
| 30 | may adopt rules to implement this section. |
| 31 | Section 2. This act shall take effect July 1, 2012. |
