1 A bill to be entitled
2 An act relating to teenage drivers; creating s.
3 322.097, F.S.; providing for the Department of Highway
4 Safety and Motor Vehicles to electronically notify a
5 parent or guardian when certain events are added to
6 the driving record of a minor licensed to drive;
7 providing for discontinuance of the notifications;
8 providing for forms; providing for a fee; providing
9 for the adoption of rules; providing an effective
10 date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Section 322.097, Florida Statutes, is created to
15 read:
16 322.097 Teen electronic event notification service.—
17 (1) Upon application and receipt of the appropriate fee, as
18 described in subsection (4), from a parent or guardian of a
19 person who has not attained 18 years of age and who holds a
20 valid driver license or learner’s driver license, the department
21 shall notify the parent or guardian each time any of the
22 following events is added to the person’s driving record:
23 (a) Conviction of any traffic violation.
24 (b) A notice of pending suspension, revocation,
25 disqualification, withdrawal, or cancellation of the licensee’s
26 privilege to drive or driver license.
27 (c) Suspension, revocation, disqualification, withdrawal,
28 or cancellation of the licensee’s privilege to drive or driver
29 license.
30 (d) An at-fault vehicle crash.
31 (2) Forms for applications under subsection (1) shall be as
32 prescribed by the department.
33 (3) Notifications under subsection (1) shall be made
34 electronically to the parent’s or guardian’s e-mail address or
35 telephone text messaging system, as requested by the parent or
36 guardian. The notifications shall be discontinued upon request
37 by the parent or guardian receiving the notifications or when
38 the licensee attains 18 years of age.
39 (4) The department shall charge a one-time fee of $5 to
40 cover the administrative costs of the notifications. Any amounts
41 received which are greater than the cost to administer the
42 program shall be used by the department to promote safe driving
43 by teenagers.
44 (5) The department may adopt rules as necessary to
45 administer this section.
46 Section 2. This act shall take effect October 1, 2012.
