Senator Detert moved the following:
1 Senate Amendment (with title amendment)

3 Delete lines 1099 - 1108
4 and insert:
5 (5)(a) The executive director may not approve an economic
6 development incentive application unless the application
7 includes a signed written declaration by the applicant which
8 states that the applicant has read the information in the
9 application and that the information is true, correct, and
10 complete to the best of the applicant’s knowledge and belief.
11 (b) After an economic development incentive application is
12 approved, the awardee shall provide, in each year that the
13 department is required to validate contractor performance, a
14 signed written declaration. The written declaration must state
15 that the awardee has reviewed the information and that the
16 information is true, correct, and complete to the best of the
17 awardee’s knowledge and belief.
18 (6) In the event of default on the performance conditions
19 specified in the contract or agreement, or violation of any of
20 the provisions found in this section, the state may, in addition
21 to any other remedy provided by law, bring suit to enforce its
22 interest.
23 (7)(3) The department shall validate contractor performance
24 and report. such Such validation shall be reported in the annual
25 incentives incentive report required under s. 288.907.
26 (8) The department is authorized to adopt rules to
27 implement this section.

32 and insert:
33 Commission; prohibiting the executive director from
34 approving an economic development incentive
35 application unless a specified written declaration is
36 received; requiring an awardee to provide a signed
37 written declaration in specified years; providing that
38 the state may bring suit
