       Senator Detert moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 2314 - 2331
    4  and insert:
    5         (a) Appeals referees.—
    6         1. The Department of Economic Opportunity shall appoint one
    7  or more impartial salaried appeals referees in accordance with
    8  s. 443.171(3) to hear and decide appealed claims.
    9         2. An appeals referee must be an attorney in good standing
   10  with the Florida Bar or be successfully admitted to the Florida
   11  Bar within 8 months after his or her date of employment. This
   12  subparagraph does not apply to an appeals referee appointed
   13  before January 1, 2014.
   14         3. A person may not participate on behalf of the department
   15  as an appeals referee in any case in which she or he is an
   16  interested party.
   17         4. The department may designate alternates to serve in the
   18  absence or disqualification of any appeals referee on a
   19  temporary basis. These alternates must have the same
   20  qualifications required of appeals referees.
   21         5. The department shall provide the commission and the
   22  appeals referees with proper facilities and assistance for the
   23  execution of their functions.
