       The Committee on Environmental Preservation and Conservation
       (Gardiner) recommended the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 84 and 85
    4  insert:
    5         Section 3. Subsections (13) and (14) are added to section
    6  373.406, Florida Statutes, to read:
    7         373.406 Exemptions.—The following exemptions shall apply:
    8         (13) Nothing in this part, or in any rule, regulation, or
    9  order adopted pursuant to this part, applies to construction,
   10  alteration, operation, or maintenance of any wholly owned,
   11  manmade farm ponds as defined in s. 403.927 constructed entirely
   12  in uplands.
   13         (14) Nothing in this part, or in any rule, regulation, or
   14  order adopted pursuant to this part, may require a permit for
   15  activities affecting wetlands created solely by the unauthorized
   16  flooding or interference with the natural flow of surface water
   17  caused by an unaffiliated adjoining landowner. This exemption
   18  does not apply to activities that discharge dredged or fill
   19  material into waters of the United States, including wetlands,
   20  subject to federal jurisdiction under section 404 of the federal
   21  Clean Water Act, 33 U.S.C. s. 1344.
