    1                        A bill to be entitled                      
    2         An act relating to the Florida Fire Prevention Code;
    3         amending s. 633.0215, F.S.; requiring fire officials
    4         to enforce Florida Building Code provisions for
    5         occupancy separation for certain structures with
    6         certain occupancies; exempting certain farming and
    7         ranching structures from the code; providing an
    8         effective date.

   10  Be It Enacted by the Legislature of the State of Florida:
   11  
   12         Section 1. Subsection (16) is added to section 633.0215,
   13  Florida Statutes, to read:
   14         633.0215 Florida Fire Prevention Code.—
   15         (16)(a) For one-story or two-story structures that are less
   16  than 10,000 square feet, whose occupancy is defined in the
   17  Florida Building Code and the Florida Fire Prevention Code as
   18  business or mercantile, a fire official shall enforce the wall
   19  fire-rating provisions for occupancy separation as defined in
   20  the Florida Building Code.
   21         (b) A structure, located on property that is classified for
   22  ad valorem purposes as agricultural, which is part of a farming
   23  and ranching operation, which employs fewer than 35 full-time
   24  equivalent workers, and which is not used by the public for
   25  direct sales or as an educational outreach facility, is exempt
   26  from the Florida Fire Prevention Code, including the national
   27  codes and Life Safety Code incorporated by reference. This
   28  paragraph does not include structures used for residential or
   29  assembly occupancies, as defined in the Florida Fire Prevention
   30  Code.
   31         Section 2. This act shall take effect July 1, 2013.
