       Appropriations Subcommittee on Transportation, Tourism, and
       Economic Development (Brandes) recommended the following:
       
    1         Senate Amendment to Amendment (421682) (with title
    2  amendment)

    4         Delete lines 5 - 9
    5  and insert:
    6  Section 49. Present section 323.002, Florida Statutes, is
    7  amended and a new subsection (3) is added to that section, to
    8  read:
    9         323.002 County and municipal wrecker operator systems;
   10  penalties for operation outside of system.—
   11         (1) As used in this section, the term:
   12         (a) “Authorized wrecker operator” means any wrecker
   13  operator who has been designated as part of the wrecker operator
   14  system established by the governmental unit having jurisdiction
   15  over the scene of a wrecked or disabled vehicle.
   16         (b) “Unauthorized wrecker operator” means any wrecker
   17  operator who has not been designated as part of the wrecker
   18  operator system established by the governmental unit having
   19  jurisdiction over the scene of a wrecked or disabled vehicle.
   20         (c) “Wrecker operator system” means a system for the towing
   21  or removal of wrecked, disabled, or abandoned vehicles, similar
   22  to the Florida Highway Patrol wrecker operator system described
   23  in s. 321.051(2), under which a county or municipality contracts
   24  with one or more wrecker operators for the towing or removal of
   25  wrecked, disabled, or abandoned vehicles from accident scenes,
   26  streets, or highways. A wrecker operator system must include a
   27  requirement that authorized wrecker operators must maintain
   28  liability insurance of at least $300,000, and on-hook cargo
   29  insurance of at least $50,000. A wrecker operator system must
   30  shall include using a method for apportioning the towing
   31  assignments among the eligible wrecker operators through the
   32  creation of geographic zones, a rotation schedule, or a
   33  combination of these methods.
