       Senator Legg moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 176 - 182
    4  and insert:
    5  such construction, the utility may not recover any further rate
    6  of return under this section. The utility must provide written
    7  notice of this election to the commission within 14 days after
    8  making the election. Failure by the utility to timely notify the
    9  commission is a violation of this section and punishable under
   10  s. 350.127. Any cost recovery after the date of the election not
   11  to complete construction of the plant may not include a rate of
   12  return.
