    1                        A bill to be entitled                      
    2         An act relating to the State Board of Education;
    3         amending s. 1001.02, F.S.; requiring the State Board
    4         of Education to adopt rules in writing before
    5         implementing a new statute or program, changing rules
    6         for an existing program, or amending written technical
    7         assistance papers; providing an effective date.

    9  Be It Enacted by the Legislature of the State of Florida:
   10  
   11         Section 1. Subsection (1) of section 1001.02, Florida
   12  Statutes, is amended to read:
   13         1001.02 General powers of State Board of Education.—
   14         (1) The State Board of Education is the chief implementing
   15  and coordinating body of public education in Florida except for
   16  the State University System, and it shall focus on high-level
   17  policy decisions. It may has authority to adopt rules pursuant
   18  to ss. 120.536(1) and 120.54 to implement the provisions of law
   19  conferring duties upon it for the improvement of the state
   20  system of K-20 public education except for the State University
   21  System. The State Board of Education must adopt rules in writing
   22  at least 30 days before implementing a new statute or program,
   23  changing rules governing an existing program, or amending a
   24  written technical assistance paper created by the department.
   25  Except as otherwise provided herein, it may, as it finds
   26  appropriate, delegate its general powers to the Commissioner of
   27  Education or the directors of the divisions of the department.
   28         Section 2. This act shall take effect July 1, 2013.
