Senator Soto moved the following:

5 (2)(a) By November 15, 1997, and annually thereafter, each
6 water management district shall submit to the department for
7 review and approval a priority list and schedule for the
8 establishment of minimum flows and levels for surface
9 watercourses, aquifers, and surface waters within the district.
10 The priority list and schedule must shall also identify those
11 listed water bodies for which the district will voluntarily
12 undertake independent scientific peer review; any reservations
13 proposed by the district to be established pursuant to s.
14 373.223(4); and those listed water bodies that have the
15 potential to be affected by withdrawals in an adjacent district
16 for which the department’s adoption of a reservation pursuant to
17 s. 373.223(4) or a minimum flow or level pursuant to subsection
18 (1) may be appropriate.
19 (b) By March 1, 2006, and annually thereafter, each water
20 management district shall include its approved priority list and
21 schedule in the consolidated annual report required by s.
22 373.036(7). The priority list must shall be based upon the
23 importance of the waters to the state or region and the
24 existence of or potential for significant harm to the water
25 resources or ecology of the state or region, and must shall
26 include those waters that which are experiencing or may
27 reasonably be expected to experience adverse impacts. Each water
28 management district’s priority list and schedule must shall
29 include all first magnitude springs, and all second magnitude
30 springs within state or federally owned lands purchased for
31 conservation purposes. The specific schedule for establishment
32 of spring minimum flows and levels must shall be commensurate
33 with the existing or potential threat to spring flow from
34 consumptive uses. Springs within the Suwannee River Water
35 Management District, or second magnitude springs in other areas
36 of the state, need not be included on the priority list if the
37 water management district submits a report to the Department of
38 Environmental Protection demonstrating that adverse impacts are
39 not now occurring and nor are not reasonably expected to occur
40 from consumptive uses during the next 20 years. The priority
41 list and schedule are shall not be subject to any proceeding
42 pursuant to chapter 120. Except as provided in subsection (3),
43 the development of a priority list and compliance with the
44 schedule for the establishment of minimum flows and levels
45 pursuant to this subsection satisfy shall satisfy the
46 requirements of subsection (1).
47 (c) Beginning January 1, 2014, and quarterly thereafter,
48 each water management district shall submit a report on the
49 progress of spring restoration efforts to the Governor, the
50 President of the Senate, and the Speaker of the House of
51 Representatives.
