The Committee on Appropriations (Bradley) recommended the
following:
1 Senate Amendment (with title amendment)

3 Between lines 351 and 352
4 insert:
5 Section 2. Subsection (4) of section 893.0355, Florida
6 Statutes, is amended to read:
7 893.0355 Control of scheduled substances; delegation of
8 authority to Attorney General to reschedule substance, or delete
9 substance, by rule.—
10 (4) Rulemaking under this section shall be in accordance
11 with the procedural requirements of chapter 120, including the
12 emergency rule provisions found in s. 120.54, except that s.
13 120.54(7) does not apply. The Attorney General may initiate
14 proceedings for adoption, amendment, or repeal of any rule on
15 his or her own motion or upon the petition of any interested
16 party.
