    1                        A bill to be entitled                      
    2         An act relating to ticketholders’ rights; creating s.
    3         501.166, F.S.; declaring that an event or admission
    4         ticket purchased by an individual consumer is the
    5         consumer’s personal property; providing that certain
    6         restrictions on the transfer or resale of event or
    7         admission tickets are void; providing for
    8         applicability; providing an effective date.

   10  Be It Enacted by the Legislature of the State of Florida:
   11  
   12         Section 1. Section 501.166, Florida Statutes, is created to
   13  read:
   14         501.166 Ticketholders’ rights.—An event or admission ticket
   15  purchased by an individual consumer is deemed the personal
   16  property of the consumer. Any restriction imposed upon the
   17  purchase of the ticket by the ticket seller or its agent which
   18  prohibits the consumer from transferring or reselling the ticket
   19  to another individual consumer, or which imposes conditions upon
   20  or prescribes the means or methods of such transaction, is void.
   21  This section does not affect the applicability or enforcement of
   22  s. 817.355, s. 817.357, s. 817.36, or s. 817.361, or authorize
   23  any activity that otherwise violates any of those sections.
   24         Section 2. This act shall take effect July 1, 2013.
